PUBLIC UTILITY EASEMENT
THIS INDE;NTURE MADE and entered into this .16- day of'7 ,2001, by and between Darrvl
S. Doaali and Dorothv C. Doaali , hereinafter referred to as the Grantors, and the CITY OF SPRINGFIELD, a.
municipal corporation, in Lane County, hereinafter referred to as the Grantee.
WITNESSETH: In consideration of the acceptance by Grantee and the use or holding of said easement for
present or future public use by Grantee, Grantors hereby grant, bargain, sell and convey unto the Grantee, a
perpetual easement 7.00 feet in width, together with the right to go upon said easement area hereinafter
described for the purpose of constructing, reconstructing, maintaining and using public utilities which may
hereafter be installed on the following described property, to-wit:

TO HAVE AND TO HOLD the above easement to the said Grantee, its heirs and assigns forever.

Highway and the Southerly 7.00 feet, adjoining and parallel to the Southerly right of way of
South "A" Street, of the following described tract:
That tract of land, described in a deed from Donald Joe Duncan and Mary Ann Duncan to Darryl
S. Dogali and Dorothy C. Dogali, recorded for public record February 16, 1999, on Reel 2516R
at Reception No. 99-014091, Lane County Official Records, Lane County, Oregon, being more
completely described as follows:
Beginning at a point that is 202.90 feet North 00 13' West and 1362.35 feet North 780 22' East
of the Southwest corner of the Nelson Davis Donation Land Claim No. 50, Township 17 South,
Range 2 West of the Willamette Meridian, Lane County, Oregon; running thence North 110 38"

LAND USE COMPATIBILITY STATEMENT (lUeS)
WHAT IS A lUeS? The LUCS is the process DEQ uses to determine that DEQ permits and othecapprovals that affect
land use are consistent with the local government comprehensive plan. .
WHY IS A lUCS REQUIRED? Oregon faw requires that state agency activities that impact land use be consistent with
local comprehensive plans. DEQ Division 1 a administrative rules identify agency actions that are defined as programs
affecting land use. These programs must have a process for determining focaf plan consistency.
WHEN IS A lUCS REQUIRED? A lUCS is required for nearfy aU-DEQ permits, some generaf permits, and certain
approvals of plans or reiate<i activities that affect land use. These activities are fisted in this form. In cases where
a source needs more than one DEQ permit or approval, a single lUeS may be used.
A permit modification requires a LUeS when: .
there is a physical expansion on the property or the use of additional land is proposed
there is a significant increase in discharges to water
there is a. relocation of an outfaU outside of the source propertY. or .
there is any physical change or change of operation of an air poUutant source that results iil a net significant
emission rate increase as defined in OAR 340-28-110.
A permit renewal requires a LUeS if one has not previously been submitted. or if one of the above four permit
modification factors apply.

HOW TO COMPLETE A LUCS:
ThelUCS form is induded inthe DEQ permit application or approval packet
Applicant fiUs out Section 1 ot the lUCS and then submits it to the city or county planning office.
The local planning office determines if the business or facility meets aU local planning requirements.
The local planning office must attach written findings offact tor local reviews or other necessary planning approvals
that are required of the applicant. .
The applicant indudes the completed LUeS and attachments with the permit application or approvaf request submittal.
