ACTION REQUESTED: Adopt or reject the following resolution: A RESOLUTION TO ACCEPT PERMIT PROJECT P30400 SHEDRICK PARTITION CUL-DE-SAC ON ASTER ST. ISSUE STATEMENT: This permit project was engineered by Olson and Morris Engineers and constructed by Boles Construction Company The work on this public improvement project has been completed. The City Council must formally accept the work on the project for the City's use, operation, maintenance, and ownership. ATTACHMENTS: 1. Resolution DISCUSSION/ FINANCIAL IMPACT: This project consisted of the completion of a cul-de-sac to include paving, sidewalks, driveway approaches, street trees and the installation of a street light. The developer of the project, Juan Shedrick of Shedrick Enterprises, failed to complete the improvements as agreed and all attempts to compel Mr. Shedrick to honor his agreement were unsuccessful. On March 29, 2011, the City filed a claim in the amount of $3,800.00 with Western Surety Company for the full amount of the Performance Bond presented by Mr. Shedrick as financial security for the project. Payment was received on April 25, 2011 and these funds were used to complete the project and obtain as-built drawings and acceptance documentation. Although the City did receive payment on its claim on the Performance Bond, the payment was not sufficient to cover all the City’s costs on the project. Staff estimates that the City expended between $4,000 and $5,000 more than the revenue received from the developer’s deposits and the bond proceeds to complete this project. All work has been inspected by Olson and Morris Engineers and the City Engineer and found to be satisfactory. Staff does not have a final construction costs for this project, as it was privately engineered, built and financed. There is no additional financial impact to the City other than future operation and maintenance responsibilities. RESOLUTION NO. _______ Acceptance WHEREAS, work on the improvement described below has been fully completed and has been duly inspected by the City Engineer of the City of Springfield: P30400; SHEDRICK PARTITION CUL-DE-SAC ON ASTER ST, and WHEREAS, said work was found to be in conformance with the terms of the contract now on file in the City Recorder’s office; and, WHEREAS, it is the recommendation of the City Engineer that this improvement project be accepted and permanently included in the improvement maintenance program of the City of Springfield. NOW THEREFORE BE IT RESOLVED as follows: 1) The Common Council of the City of Springfield does hereby accept for future maintenance the above-described project and accepts said improvement from the contractor involved. 2) This resolution shall take effect upon adoption by the Council and approval by the Mayor.
