HomeMy WebLinkAboutOrdinance 6278 06/18/2012ORDINANCE NO. 6278 (General) AN ORDINANCE AMENDING THE TITLE OF SECTIONS 8.000 THROUGH 8.016 OF THE SPRINGFIELD MUNICIPAL CODE AND SECTIONS .8.000, 8.005, 8.010(5), 8.012(1) & (6) AND 8.015 OF THE SPRINGFIELD MUNICIPAL CODE TO EXPAND TEMPORARY OVERNIGHT SHELTER TO INCLUDE HOMELESS OVERNIGHT PARKING ON INDUSTRIAL SITE PROPERTIES AND DECLARING AN EMERGENCY WHEREAS, the Springfield Council recognizes the growing number of homeless Springfield residents created by the ongoing economic conditions warrants additional emergency overnight shelter sites; and WHEREAS, the Springfield Council has declared' its intention to expand existing programs for temporary emergency shelter on real property industrial sites zoned. Heavy or Light- Medium Industrial and developed with a permitted use to allow emergency overnight shelter of Springfield residents; and WHEREAS, the proposed emergency overnight shelter program is in the best interest of homeless Springfield residents, the public health, safety and welfare of all City of Springfield residents and the plans and programs for the general development of the City. NOW, THEREFORE, based on the foregoing recitals, the City of Springfield ordains as follows: Section 1: The title of the Springfield Municipal Code Sections 8.000 through 8.016 is hereby amended to read as follows: "CHURCHES AND INDUSTRIAL SITE PROPERTIES AS TEMPORARY EMERGENCY SHELTER FORTHE HOMELESS" Section 2: Springfield Municipal Code Section 8.000, General, is hereby amended to read as follows: "8.000 General The requirements specified in sections 8.000 to 8.016 shall be considered .the minimal requirements to establish, maintain, and operatea temporary emergency shelter at a church or industrial site property. The Development and Public Works Director, or appointee, shall approve the temporary emergency shelter use if the applicable requirements specified in sections 8.000 to 8.016 have been met." 1 Section 3: Springfield Municipal Code Section 8.005, Definitions, is hereby amended to add a definition for "Industrial Site" as follows: "Industrial Site. Property having Heavy or Light- Medium Industrial zoning in accordance with Section 3.2 -400 of the Springfield Development Code and, a primary use approved in accordance development review procedures of the Springfield Development Code." Section 4: Springfield Municipal Code Section 8.010(5), Approval Process for Indoor Shelter, is hereby amended to read as follows: "(5) All vehicles owned by the homeless shall be parked in the church parking lot." Section 5: Springfield Municipal Code Section 8.012(1)' Approval Process for Outdoor Overnight Shelter, is hereby amended to read as follows: "(1) Notwithstanding any other provisions of this code, persons may take overnight shelter in a vehicle, camper or trailer in the parking lot of a church or industrial site on which a parking lot and occupied structure are located in accordance with current code, with the written permission of the property owner when the site is part of a supervised program operated by the city or its agent. The placement of more than one vehicle, camper or trailer for sleeping at any one time shall be prohibited." Section 6: Springfield Municipal Code Section 8.012, Approval Process for Outdoor Overnight Shelter, is hereby amended to add Section (6) to read as follows: "(6) Nothing in Section 8.012 creates any requirement, right or responsibility of the participants to act as security or -provide night watchmen's services as defined by ORS 181.870(6) & (8)." . Section 7: Springfield Municipal Code Section 8.015, Revocation, is hereby amended to read as follows: "8.015 Revocation Where it has been determined that any participating property is not in compliance with the requirements of sections 8.000 through 8.016 by city staff, including, but not limited to, police, fire, building, or code enforcement, the City Manager may revoke the Director's approval. The. revocation decision may be appealed to the City Council. The City Council may affirm, modify or reverse the revocation." 2 ORDINANCE NO. 6278 Section 8: It is hereby found and determined that matters relating.to temporary overnight shelter for the homeless are matters effecting the public health, safety, and welfare and that an emergency exists and that.therefore, this ordinance shall take effect immediately upon its passage by the Council and approval by the Mayor. ADOPTED by the Council of the City of Springfield this .18th day of June, 2012, by a vote of 6 for and o against. APPROVED by the Mayor of the City of Springfield this 18th day of June, 2012.
