HomeMy WebLinkAboutResolution 2012-08 06/18/2012RESOLUTION No. 2012 -08 A RESOLUTION OF THE CITY OF SPRINGFIELD COMMON COUNCIL AMENDING RESOLUTION NO. 2012 -05 "SETTING LOCAL AND REGIONAL SEWER USER FEES AND LOCAL STORMWATER USER FEES AS SET FORTH IN THE SPRINGFIELD MUNICIPAL CODE" WHEREAS, on May 7, 2012, the Common Council adopted Resolution No.,2012 -05 "SETTING LOCAL AND REGIONAL SEWER USER FEES AND LOCAL STORMWATER USER FEES AS SET FORTH IN THE SPRINGFIELD MUNICIPAL CODE "; and WHEREAS, Exhibit A to Resolution No. 2012 -05 contained an error specifying that Stormwater (Drainage) fees beginning with bills rendered on or after July 1; 2012, shall, be on, "All real property, with the exception of single family dwellings, shall be charged $1.89 (an incorrect amount) plus the product of the property area_ (in square feet), runoff coefficient, and $3.525 per 1,000 square feet "; and WHEREAS, the correct charge for Stormwater (Drainage) fees beginning with bills rendered on or after July 1, 2012, shall be on, "All real property, with the exception of single family dwellings, shall be charged $1.40 (the correct amount) plus the product of the property area (in square feet), runoff coefficient, and $3.525 per 1,000 square feet." NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Springfield as follows: 1. Exhibit A to Resolution No. 2012 -05 "SETTING LOCAL AND REGIONAL SEWER USER FEES AND LOCAL STORMWATER USER FEES AS SET FORTH IN THE SPRINGFIELD MUNICIPAL CODE" is hereby amended and adopted as Exhibit A attached hereto and shall take effect with bills rendered on or after July 1, 2012. 2. . Except as hereby specifically amended all other terms and conditions of Resolution No. 2012 -05 including Exhibit A thereto shall remain in full force and effect. 3. This Resolution shall take effect immediately upon adoption by. the Council and signature by the Mayor. 4. If any provision of this Resolution is declared by a court to be illegal or in conflict with any law, the validity of the remaining provisions shall not be affected and this Resolution shall be enforced as if it did not contain the particular provision held to be invalid. Adopted by the Common Council of the City of Springfield, Oregon, by a vote of 6 for and 0 against, this 18thday of June, 2012.
