ACTION REQUESTED: Approval of following motion: ALLOW CONSTRUCTION ACTIVITIES OUTSIDE OF THE HOURS OF 7 AM AND 6 PM WITH CONDITIONS, AS DESCRIBED IN ATTACHMENT 1, FOR THE 58TH STREET FLOW CONTROL FACILITY PROJECT (P21046). ISSUE STATEMENT: Section 5.220(c) of the Springfield Municipal Code allows construction activities between 7 am and 6 pm. In order to complete project work in the 54th and Main Street vicinity in a timely manner, reduce the project’s impact on traffic, and meet the requirements of the Oregon Department of Transportation (ODOT) facilities permit, it will be necessary to allow the contractor to work outside of the allowable 7 am to 6 pm hours. ATTACHMENTS: 1: Conditions for approval. DISCUSSION/ FINANCIAL IMPACT: In order to alleviate capacity problems in the wastewater collection system and prevent future sanitary sewer overflows, the City of Springfield will construct the “58th Street Flow Control Facility” (P21046). Nighttime work will be needed at the 54th and Main Street intersection for trenching and installing sanitary sewer pipe and manholes, followed by pavement restoration. The work will commence during the upcoming construction season. The City plans to open bids on the project in June 2012. Work performed within the Main St. corridor is subject to approval from ODOT. Based on preliminary conversations with ODOT permit specialists, work hours will be restricted to between 9:00pm and 6:00am. Performing the work at night will minimize the impact to commuters but may impact the neighboring residential areas. The duration of required night work is anticipated to be 3 weeks or less. Staff is seeking approval of a noise variance now as the project team would like to include the approval and conditions within the bid documents. Noise generated from the work will come from generators, concrete saws, backhoes and/or excavators, paving equipment, rollers, trucks and passenger vehicles. Most of the moving equipment will have back-up alarms, required by OSHA rules. Extensive public outreach will be conducted prior to and continuing through construction of the project. Specific periods of night work will be coordinated with the contractor. A Springfield staff member will be involved in the construction team and will communicate anticipated night work to Council, staff and the public. To the extent practicable City staff will work with the contractor to minimize the disruption to the residential areas using the conditions outlined in Attachment 1. Having reviewed the alternatives, staff recommends approval of night work at the 54th and Main Street intersection with the conditions in Attachment 1. Noise Variance Request City of Springfield 58th Street Flow Control Facility (P21046) Detailed location of night work request: 1) The intersection of 54th Street and Main Street in Springfield, Oregon. Work immediately adjacent to those limits will be permitted for installation and maintenance of traffic control devices. Conditions for approval: 1) City of Springfield staff shall be involved in on-going coordination of the project construction and shall be notified as soon as possible about upcoming night work. This notice shall be given at least 10 working days prior to the planned commencement of the night work activities. 2) Nighttime work and lane closures shall be timed to avoid high-traffic periods, such as large local events or holidays, to the extent possible. 3) Springfield staff will have the authority to restrict the hours certain activities occur as part of night work approval. 4) Springfield staff will have authority to deny Contractor’s request for specific night work days, based on local events or anticipated high traffic periods, and will work with the Contractor and the ODOT permit specialist to identify alternate work periods. 5) ODOT and Springfield staff shall follow the public notification process outlined in the project communication plan. 6) No work shall commence under the City Council approved Noise Variance until Springfield staff provide written authorization to the ODOT permit specialist. 7) Additional items or information may be requested or required prior to approval of nighttime work.
