The applicants request approval of a Tree Felling Plan to selectively remove approximately 30
deciduous trees from a five (5) acre lot adjacent to the McKenzie River.
LOCATION AND ZONING OF THE PROPERTY
The property is located at 3306 Baldy View Lane and is also described as tax lot 1001 on
Lane County Assessor's Map #17-03-22. The property is zoned Medium Density
Residential/Urbanizable Fringe (MDR/UF); Metro Plan designation is also MDR.
BACKGROUND/SITE INFORMATION
Tree removal is requested for the following reasons: 1) to prepare a site for a 1500-square
foot expansion of the existing home (approximately 15 trees are located within the area for
the proposed addition); 2) to remove diseased trees and; ,3. to remove trees located in
powerline areas which create a hazard.
The applicant has provided recommendations from local professionals, including a tree surgeon
(Bruce Nelson) and a certified ,arborist (Paul Braverman), justifying the need for this request.
The applicant has also submitted a replanting plan to mitigate for the removed trees and to
partially restore the riparian riverbank area with native vegetation. Tree felling will be
performed by a professional tree removal company. The trees and slash will be removed from
the site by truck. Slash will be sold commercially for chip fiber.
SITE DESCRIPTION
The property is located at the confluence of the main channel of the McKenzie with a
secondary channel. The site is developed with a residence located approximately 160 feet
from the bank. Native vegetation adjacent to the riverbank has been replaced with lawn. The
property is generally flat with a moderate slope towards the river. Over 350 trees are on the
property, including several prominent stands of big-leaf maple. This wooded area provides a

significant scenic amenity as well as wildlife habitat'value, particularly birds. According to
the professionals evaluating the site, the tree stands are'approximately 80-years old, but many
are in declining status, with decayed and rotten cores, amarillo root rot and weak upper
crotches.
DECISION
The application has been approved with conditions. The decision is valid for 12 months from
the date of this letter.
CRITERIA FOR APPROVAL
Ref. Article 38 of the Springfield Development Code:
The Director in consultation with the Public Works Director and Fire Chief shall approve,
approve with conditions or deny the request based on the following standards. In order to
receive approval for a Tree Felling Permit, the applicant must satisfy each of the applicable
standards. The findings adddressing each of the standards support the approval of the tree
felling permit.
(1) Whether the conditions of the trees with respect to disease, hazardous or unsafe
conditions, danger of falling, proximity to existing structures or proposed construction,
or interference with utility services or pedestrian or vehicular traffic safety; warrants
the proposed felling.
The applicant states that the forest stand requires selective cutting to remove diseased trees;
minimize unsafe conditions; and clear a site for the proposed construction.
The proposed building expansion extends south and west of the existing residence. Due to
the placement of the home on the lot, it is not possible to expand the residence in another
way which would result in fewer trees felled. A septic tank and drainfield line are situated
east of the residence; a driveway and heavily wooded areas lie to the northwest.
Letters provided by Bruce Nelson and Paul Braverman confirm the presence of decayed and
rotten cores, armarillo root rot and declining trees. Some trees overhang powerlines and are
located extremely close to the home. During the period this application was reviewed,
diseased trees adjacent to the residence and marked for, felling, toppled over within inches of
the residence.
(2) Whether the proposed felling is consistent with State standards. Metro Plan policies
and City ordinances and provisions affecting the environmental quality of the area,
including but not limited to, the protection of nearby trees and windbreaks; wildlife;
erosion, soil retention and stability; volume of surface runoff and water quality of
streams; scenic quality; and are geological sites.
The Metro Plan dire'cts local jurisdictions to carefully develop sites that provide visual diversity
to the urban area and optimize visual and personal access to residents.

The Springfield Development Code (SDC) is an implementing ordinance of the Eugene-,
Springfield Metropolitan Area General Plan (Metro Plan) and Article 38, TREE FELLING
STANDARDS, generally implements policies of the relevant elements of the Metro Plan.
. Forestry practices in the State are governed by the State Forest Practices Act. However,
. State forestry practices rules do not apply within the UGB. Policy 14 of the Environmental
Resources Element of the Metro Plan states: "Metropolitan goals relating to scenic quality,
water quality, vegetation and wildlife, open space, and recreational potential shall be given
higher priority than timber harvest within the urban growth boundary." Article 38 implements
this policy by requiring affirmative findings for criteria 38.040 (4)(a-i) as a condition of
approval for a tree felling permit. The applicant addreses the standards of Article 38 in the
application.
(3) Whether it is necessary to remove trees in order to construct proposed improvements
in accordance with an approved development plan,
The applicant submitted, a tentative plan for expansion of the existing dwelling. The
expansion requires the removal of 15 trees.
(4) In the event that no Plot Plan has been approved by the City, felling of trees shall be
permitted on a limited basis consistent with the preservation of the site's future development
potential as prescribed in the Metro Plan and City development regulations, and consistent
with the following criteria: '
(a) wooded areas associated with natural drainageways and water areas shall be
retained to preserve riparian habitat and to minimize erosion;
The McKenzie floodway boundary extends approximately 60 feet onto the property. No
structures or tree felling is proposed within this area. Other natural drainageways have been
identified north and east of the site, but do not affect the subject property, Tree removal is
designated for areas located at least 1 00 feet from the riverbank, and therefore will not have
any effect on water quality or bank erosion.
(b) wooded areas that will likely provide attractive on-site views to occupants of future
developments shall be retained;
The site contains a mixture of deciduous and coniferous trees and lawn area extending from'
the riverbank to the residence. The selective thinning of the diseased and weak trees will
open the forest for better light and air circulation, promoting a healthier forest. The views of
the site from the public street and river will not be appreciably changed; the site will still
appear developed with a residence, surrounded by prominent vegetation. .
(c) wooded areas along ridgelines and hilltops shall be retained for their scenic and
wildlife value;

The site is predominently flat with a moderate slope adjacent to the bank, and does not
contain ridge lines or hilltops.

(d) wooded areas along property' lines shall be retained to serve as buffers from
adjacent properties:
No trees are proposed to be removed along property lines. However, the applicant intends to
increase the wooded areas along the east and west p'roperty lines by planting approximately
20 evergreen trees (spruce and fir) along these areas once the remodel is completed.
(e) trees shall be retained in sufficiently large area and dense stands so as to ensure
against windthrow;
This proposal would selectively prune trees from dense stands and remove isolated trees. An
arborist will monitor the remaining trees during construction to ensure their continued health
and vitality.
(f) large-scale clear-cuts of developable areas shall be avoided to retain the wooded
character of future building sites, and so preserve housing and design options for
future City residents,
There will be no clear-cutting on this site.
(5) Whether the applicant's proposed replanting of new trees or vegetation is an adequate
substitute for the trees to be felled,
The arborist has indicated that the proposed plan will not have any effect on the bird
population, provided the existing trees_are monitored and additional trees are replanted. The
applicant's replanting plan includes a mixture of evergreen and deciduous trees representative
of the mixed forest indigeneous to this area. The planting of dogwood and japanese maple
trees will enhance wildlife habitat by providing fruit and nesting for songbirds. Additionally,
the applicant has provided a plan for restoring the riverbank area to a more natural state. The
plan includes riverbank restoration and planting of native riparian vegetation to increase bank
stability, provide protective cover for wildlife, and improve the scenic value of the site.
(6) Whether slash left on the property poses significant fire hazard or liability to the City.
The applicant plans to remove the slash from the property by truck. No dry timber will be left
on-site which could promote fire hazards.
(7) Whether the felling is consistent with the guidelines set forth in the Field Guide to Oregon
Forestry Practices Rule published by the State of Oregon, Department of Forestry, as they
apply to the northwest Oregon region,
The applicant shall provide certification that the tree felling is consistent with state forestry
standards.
(8) Whether transportation of equipment to and equipment and trees from the site can be
accomplished without a major disturbance to nearby residents.

The closest adjacent residences are located at least 600 feet east and west of the site: Staff
finds that the transportation of trees can be accomplished without major disturbance to
nearby 'residents. ,Lane County Road Department does not require permits for this operation.
CONDITIONS OF APPROVAL
1. All tree felling methods shall comply with the tree felling plan as submitted by the
applicant.

2. Tree removal activities shall be consistent with the Oregon Forestry Practices Rules.
Certification of ,such consistency shall be provided to the City by the applicant.
3. The applicant's arborlst shall monitor construction activites to ensure protection of wildlife
habitats specified herein and others discovered on site and to ensure that tree removal is
consistent with all provisions of the Decision of Approval. ..'
4. All replanting of trees and restoration of the riverbank shall be completed prior to issuance
of an occupancy permit by the Springfield Building Division, or a performance bond security
shall be provided in the amount equal to the estimated cost of completing the restoration
work.

The application and documents relied upon by the applicant, and the applicable criteria of
approval are availablefor a free inspection at the Development Services Department, 225 Fifth
Street, Springfield, Oregon. Copies of the documents will be made for $0.75 for the first
