Attached, I have cre9ted a chronology of land use and permit approvals which we have on record. From thE! records; I have been able to determine that the property was approved for use as a radio broadcasting studio and office for a maximum of 4 occupants, a residence with several remodels'and additions, and a duplex when one of the addition plansyvas modified to create a second unit. I do not find approvals for what you now are requesting. which is 2 living units and 'an office space. As has been conveyed in previous conversation and correspondence with the City Planning Division, they see no land use problem with the approval for two living units and an office unit. From a Building Safety Codes standpoint, we have the following concerns: , The Building Code requires a one-hour fire-resistive occupancy separation between ,living units, and/or betweer living units and the office uses. The County permit approvals address separation requirements between two living units. We need to verify if this separation has been installed, and if it has been maintained since. ' The County approvals do not address separation between office and residential use, because that was apparently not requested, or adequately conveyed as part of a request. We need to verify what the' separation condition is between the office use and adjoining residential uses on either side. Since we are now faced with additional considerations of. accessibility to ground floor living units or offices for the physically impaired, we wiil be obligated to address these considerations as well. It is our !Jnderstanding that you, are currently only requesting the, first Phase of the Condominium request, and that the actual implementation is to occur as a Phase two at some future date.' We request that you obtain' a Change Of Occupancy inspection prior to ,implementation of Phase two. The intent of that inspection will be to determine the following: Is the building in substantial compliance with the codes that were applicable at the time work was, done.' ' Has the building been adequately maintained to assure safe use as intended. ''II Has the building been altered in any way to compromise the integrity of structural, plumbing, mechanical or electrical systems. What additional Code items are applicable to the proposed use that were not previously applicable to the former use or uses. The current fee for the Change Of Occupancy inspection is $35.00. and the inspection can usually be performed within two days of submitting an application and fee.
