However, a recent trip through the subdivision on Monday, May 4th, indicated that the tree removal hadn't been restored to its properly designated location as approved by city inspectors before occupancy was approved for 856 Raintree Way. We have enclosed copies of an excerpt from the City of springfield's tree ordinance as well as a copy of the Declaration of Easements, Covenants, Conditions and Restrictions of Rainbow Estates which you signed when you closed the loan for the property. We believe the information is explanatory in nature, but we would be happy to answer any questions or perhaps you will want to refer this to someone else whom you believe is knowledgeable about such matters. Such restrictions are pretty typical of Oregon cities in the Wi11amette Valley. As an indication of this I have submitted a copy of the city of Eugene's requirements regarding street trees in our new development by Riverridge Golf Course. While Dorothy and I dislike any disharmony or conflict, we have a responsibility to the city, to our other home buyers and the protection of property values to insure the livability of the environment that is being created. Specifically, we request that you place the tree back in its original location which was approved by city officials. I believe that it is in the best interest of everyone to utilize the approved location although it doesn't appear possible from the ordinance for the tree to be planted at least 1 1/2 feet from the sidewalk and in the zone in front of your home which is about three feet from the sidewalk and is owned by the City of springfield.
