Benoit 1917 Brown ,Olympia, Washington 98501 , Dear Mrs. Benoit: .. . . :',' 11m writing with regard to your letter of ~1ay 12, 1982 concerning your property at ,4380 Aster Street, Springfield~ Oregon. Your questions are relitive to the zoning ,in that area and the legality of placing a separate electric meter on the smaller "house. , Your property is located in a low density residential zone whi:ch permits only sin- 'gle family dwellings and duplexes on corner lots. Prior to May 1, 1982; your lot was zoned IISuburban Residentialll (RA). The new Springfield Zoning Code designates . that zone as RL or Low Density Residential District. However, the ,change is in terminology only, because the permitted uses are the: same for both the new and previous districts. Please refer to the attached copies of the 1982 Springfield ,: Zoning Code and the 1978 Springfield Zoning Code. Both Zoning ,Codes permit mul- tiple dwelling units only in the higher density residential zones. The 1982 code requires a special use permit approved by the Springfield Planning Commission for higher density housing in the RL District. Your property does ,not have a special use permit for higher density housing. Your le~ter also mentions the wholesale plumbing supply storage yard adjacent to your property line. This property which abutts Main Street is zoned industrial allowing for the wholesal~ use. It is assumed, then, that the second dwelling unit on your property is a non- comforming use of a structure as defined in 15.05 of the Springfield Zoning Code (copy attached). A noncomforming structure and use of a structure may continue if such use was lawful when the property was annexed into the City: The area in':,':, which your property is located was annexed to the City :,:-oLSpri ngfi e 1 d into an RA zone from Lane County in July of 1960. We have no;:record of the zoning des- ignation and permitted uses thereof relative to your property before it was annexed to the City, but perhaps that information could be obtained from the Lane County Planning Department, 125 East 8th, Eugene, Oregon 97401. With regard to the separate electric meter, the Springfield Zoning Code does not permit,a noncomforming..structure or use of a structure to be II.. .enlarged, extended, moved or structurally altered~1I Installing a separate meter for the smaller dwelling unit would be considered as enlarging or extending the existing noncomformity. If the second dwelling was erecte~ or its use was changed after July of 1960, it is possible that the existing multiple dwelling use is not a legal one. However, our office has no records of permits having been issued for any work performed on the property during the timespan between the property's annexation and the present. This is not enough square footage to divide the lot into two conforming lots for each resident. I hope I have answered your questions.
