Dear Mrs. Hall:
With the recent adoption of the Springfield Development Code, the
City no longer regulates the size and/or height of hedges, except
for in the visiDn clearance triangle which applies to CDrner lots
only. Therefo~e, the hedge on the property at 1041 Quinalt
Street is no longer in violation of a City CDde.
No other kinds of vegetation are controlled by the City on
private property. (The Fire Department requires that grass be
trimmed to 10" or shorter during the summer months for fire
prevention purposes, but they do not consider'living shrubs and
trees of any size to be fire hazards.) Even under the previous
CDde, your neighbor could have had a solid row of, for example,
50 foot high untrimmed cedar trees. Because of this and other
similar inconsistencies with the previous Code, and several
recent landmark CDurt cases which have found that Cities can nDt
regulate vegetation Dn private property, staff recommended that
hedges no longer be classified with fence regulations. The City
CDuncil accepted that recomendation and adopted the Development
Code on May 5, 1986. (We notified you of that public hearing).
