ORDINANCE NO, 6009
AN ORDINANCE AMENDING THE SPRINGFIELD DEVELOPMENT CODE, ARTICLE 2,
DEFINITIONS, Section 2,020 AND ARTICLE 23, PLO PUBLIC LANDS AND OPEN SPACE,
Sections 23.020 and 23,100
Whereas, timely and sufficient notice of the public hearings, pursuant to Section 14,030
of the Springfield Development Code, has been provided; and
Whereas, The Springfield Development Code (SDC) was adopted by the Springfield
City Council on May 5, 1986, and amendments thereto were subsequently adopted by
Ordinance; and
Whereas, the Planning Commission of Springfield held a public hearing on the
proposed amendments regarding Wellness Centers on December 4, 2001, and approved the
request to recommend the amendments to the City Council for approval; and
Whereas, the preponderance of evidence in the record shows that the proposed
amendments recommended by the Planning Commission meets the requirements of Article 8 of
the Springfield Development Code and the requirements of applicable state and local law; and
Whereas, at the City of Springfield City Council meeting on January 22nd, the proposed
amendments were remanded to a work session; and
. Whereas, the City of Springfield City Council held the work session on February 11,
2002; and
Whereas, the City of Springfield City Council held a public hearing on the 18th day of
March, 2002, for the First Reading; and
Whereas, Monday the 1 st day of April the Springfield City Council met again for the
Second Reading; and
Whereas, findings in support of the approval of the amendments to the Springfield
Development Code are set forth in the staff report, and incorporated herein by reference; and
Whereas, based upon the above record and findings, the City Council concludes that
the proposed SDC amendments are consistent with the criteria of approval for amendments to
, the Springfield Development Code established in SDC Section 8,030.
NOW, THEREFORE, THE CITY OF SPRINGFIELD DOES ORDAIN, AS FOLLOWS:
Section 1: Section 2,020 MEANING OF SPECIFIC WORDS AND TERMS is hereby
amended to add the words and terms as described below:

"RECREATION CENTER, COMMUNITY, A public, indoor facility providing for a variety of
recreation/leisure-related activities, such as: swimming, meetings, court sports, arts and crafts,
dancing, banquets, parties, games, day-care, classes/instruction, performances,
fitness/exercise, and social referral services,"

"WELLNESS CENTER. A facility, owned by a public agency, operated by a public or non-public
agency or private individual or firm, offering wellness-related health services and/or treatment to
the public, including, but not limited to, diabetes and health education classes, physical, speech
and occupational therapy, and fitness and nutrition services, but excluding alcohol and drug
rehabilitation facilities other than prevention education,"
Section 2: Subsection (4)(k) of Section 23.020 SCHEDULE OF USE CATEGORIES is hereby
added as follows:
"(4)(k) Wellness center - S "
Section 3: Subsection (8) of Section 23,100 SPECIAL USE STANDARDS is hereby
added as follows:
"(8) For Wellness centers the following criteria shall apply:
(a) The building shall be owned by a public agency,
(b) The center shall be secondary to a primary public community recreation center on
the same development site, The square footage that is dedicated to non-public,
well ness-related uses shall not exceed 50% of the combined total area (within the
center and within the primary recreation facility) that is dedicated to public, recreation-
related uses,"
Section 4: If any section or provision of this ordinance is found to be invalid, improperly
adopted or adopted without supporting findings and evidence, such findings of invalidity shall
not invalidate or otherwise affect the remaining portions of this ordinance.
ADOPTED by the Common Council of the City of Springfield this 1st day of April, 2002,
