ORDINANCE NO. 6001 AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY KNOWN AS ARLIE & COMPANY, ET AL, LOCATED IN THE GAME FARM ROAD AREA OF NORTH SPRINGFIELD, NORTH OF HARLOW ROAD AND FLAMINGO, SOUTH OF BEL TUNE EAST, EAST OF GAME FARM ROAD, AND WEST OF THE McKENZIE RIVER; TAX LOTS 800, 900, 902, 1100, 1200, 1201,1203, AND PARTS OF 1000 AND 1400 T17S R03W S22; HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT. WHEREAS, certain real property described below was annexed to the City of Springfield by order of Lane County Local Government Boundary Commission under Boundary Commission Number C SP 01 - 17, Final Order 1181 (Expedited Procedure) and further described in Exhibit A & B, and WHEREAS, the property to be withdrawn is located within the boundaries of the Rainbow Water District, and WHEREAS, the City of Springfield Common Council held a public hearing and first reading in the Springfield City Council Chambers on February 4, 2002, and a second reading and adoption on February 19, 2002, in accordance with ORS 222.524, for the purpose of hearing any objections to the withdrawal of the property mentioned from the public service district mentioned and there having been no objections raised. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby determine that the real property described should be in the best interest of the City of Springfield withdrawn from the Rainbow Water District in Lane County, Oregon, insofar as the property >! is located therein. Section 2: The Common Council of the City of Springfield does hereby determine that the following described real property within the boundaries of the Rainbow Water District is and shall be upon the effective date of this ordinance withdrawn from the Rainbow Water District in Lane County, Oregon, said property being described as follows: Township 17South, Range 03West, Section 22, Tax Lots 800, 900, 902, 1100, 1200, 1201, 1203, and parts of 1000 and 1400; as more particularly described in Exhibit A of this ordinance, Boundary Commission File Number C SP 01 - 17, Final Order 1181. ADOPTED by the Common Council of the City of Springfield this 19th day of February, 2002, by a vote of ~ for and ~ against. APPROVED by the Mayor of the . r th day of February 2002. EXHIBIT A Beginning at a point on the Westerly margin of Baldy View Lane, (25.00 feet from, when measured at right angles to the centerline), said point bears South 26041'37" East a distance of 981.42 feet and South 89056'00" West a distance of27.97 feet from the Northeast comer of the William Stevens Donation Land Claim Number 46, located in Township 17 South, Range 3 West, Willamette Meridian; thence leaving said Westerly margin and running South 890 56'00" West parallel to the north line of said Donation Land Claim a distance of 1893.91 feet to a point on the Easterly margin of Game Farm Road (County Road No.3), (30.00 feet from, when measured at right anglesto the centerline); thence leaving said parallel line and running South 04011 '56" East along said Easterly margin a distance of78.32 feet and South 02054'56" East a distance of 110.28 feet to a point on the North boundary of that certain tract of land conveyed to the City of Springfield by deed recorded April 18, 1977, Reel 843R, Instrument Number 7722531, Lane County Official Records; thence South 89 0 56'00" West parallel to the north line of said Donation Land Claim a distance of 10.00 feet to a point, 20.00 feet from, when measured at right angles to, the centerline of said Game Farm Road; thence South 02054'56" East a distance of 411.19 feetto a point on the South bOuridary of said City of Springfield property; thence North 89056'00" East along the South boundary of said City , of Springfield property, 15.00 feet to a point which is 35.00 feet from, when measured at right angles to, the centerline of said Game Farm Road; thence leaving said south boundary and running along said Easterly margin of Game Farm Road the following courses and distances: South 02054'56" East a distance of28.13 feet, South 03 036'56" East a distance of746.75 feet, South 89054'08" West a distance of5.00 feet, , South 03 036'56" East a distance of415.58 feet, South 89027'15" East 5.01 feet and South 0303656" East a distance of 123.26 feet to a point on the Northerly margin of the vacated Southern Pacific Railroad right- of-way; thence leaving said Easterly road margin and running along the Northerly and Easterly vacated right-of-way of said railroad South 41052'17" East a distance of228.95 feet and along the arc of985.04 foot radius curve right, having a central angle of 19013'08" and a chord bearing South 32015'43" East 328.87 feet, a distance of 330.41 feet to the Northwest comer of the First Addition to Buena Vista as platted and recorded inBook 20, Page 25, Lane County Oregon Plat Records~ Lane County, Oregon; thence leaving said right-of-way and running South 89058'00" East along the North boundary of said plat and an easterly projection thereof, a distance of 1136.76 feet more or less to the center of the westerly channel of the McKenzie River; thence leaving said boundary and running downstream along the centerline of said river channel in a northeasterly direction to a point on the Westerly boundary of that certain tract of land described in deed recorded in Reel 631, Instrument Number 13809, Lane County Official Records, said point lies westerly of and 225.00 feet opposite by perpendicular measurement of a southerly projection of the centerline of afore-described Baldy View Lane, said point also bears North 26025' 09" East a distance of 142158 feet form the last described point; thence leaving said McKenzie River channel and running North 26041 '37" West along a line parallel to and 225.00 westerly by perpendicular measurement of the centerline of said Baldy View Lane a distance of 660.20 feet to the Northwest comer of that property described in last said deed; thence leaving said parallel line and running along the Northerly boundary of last said deed North 63 0 18'23" East perpendicular to said centerline a distance of200.00 feet to a point on the Westerly margin of said Baldy ViewLane; thence running along said Westerly margin North 26 041'37" West a distance of 457 .55 feetto the Point of Beginning, all in Lane County, Oregon.
