')QRR AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD AMENDING ARTICLE 28 HOSPITAL SUPPORT OVERLAY DISTRICT SECTION 28.040,28.050 AND 28.060 AS ESTABLISHED IN THE SPRINGFIELD DEVELOPMENT CODE. THE CITY COUNCIL OF THE CITY OF SPRINGFIELD FINDS THAT: 1. The Springfield Development Code (SDC) was adopted by the Springfield City Council on May 5, 1986, and amendments thereto were subsequently adopted by Ordinance. 2. Findings in support of adoption of these amendments to the SDC are set forth below: a. The proposed code amendment (Journal File Number 2001-05-0112) is consistent with the Metro Plan because the text will make the standards and use list consistent with the intent of the underlying zones which are consistent with the Metro Plan Diagram. b.There are no applicable State statutes affecting this proposed code amendment. c.This proposed code amendment is consistent with Statewide Planning Goals and Administrative Rules. The amendment merely refines an ordinance specifically prepared to facilitate the development of the hospital and hospital-related services in an area designated for that purpose. The text is consistent with the Metro Plan which is consistent with Statewide Goals and rules. 3. Based on the above record of findings, the City Council concludes that the SDC amendments are consistent with the criteria of approval for amendments to the Springfield Development Code established in SDC Section 8.030. Now, therefore, based on the above findings, THE CITY OF SPRINGFIELD CITY COUNCIL DOES ORDAIN AS FOLLOWS: Section 1: SPRINGFIELD DEVELOPMENT CODE SECTION 28.040, is hereby amended to read as follows: 28.040 REVIEW. (I) Development proposals shall be reviewed under Type IT procedure (Site Plan Review (2) A complete application together with all required materials shall be accepted by the director prior to the review of the request as specified in Section 3.050, Application Submittal. . Section 2: SPRINGFIELD DEVELOPMENT CODE SECTION 28.050, is hereby amended to read as follows: 28.050 PERMITTED USES. The following uses may be allowed in the HS Overlay District as indicated, subject to the provisions, additional restrictions and exceptions set forth in this Code. . (1 ) Physicians services. (2) Dental services. (3) Hospital services, including medical heliport. (4) Medical laboratory services. (5) Dental laboratories. (6) Group care homes. (7) Medical clinic, out-patient service. (8) Other medical and health services, including food service, cafeteria and laundry service. (9) Certain Wireless Telecommunications Systems Facilities (Article 32). Refer to Section 32.130 for siting standards and review process in the HS HOSPITAL SUPPORT OVERLAY DISTRICT. (10) Residential or skilled care facilities (11) Secondary uses such as medical-related retail and service uses, restaurants, convenience stores and services, and day care facilities not to exceed 10% of the gross floor area of all the buildings in a development area. (12) Parking garages Section 3: SPRINGFIELD DEVELOPMENT CODE SECTION 28.060, is hereby amended to read as follows: 28.060 DEVELOPMENT STANDARDS. (1) All yard, lot size, coverage, density, fencing, parking and sign standards shall be subject to the same standards as professional offices in residential districts, except hospital signs which may be internally illuminated. (2) A minimum of25 percent of the lot shall be of planted material. (3) Parking lots shall meet the planting standards applicable to commercial development. Section 4: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional by a court of competent urisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions hereof . .. . Adopted by the Common Council of the City of Springfield this 16th day of July 2001 by a vote of 6 in favor and 0 against.
