HomeMy WebLinkAboutOrdinance 5978 03/05/2001 . . . ~, ORDINANCE NO. 5978 AN ORDINANCE WITHDRAWING CERTAIN REAL PROPERTY LOCATED IN THE GATEWAY AREA OF NORTH SPRINGFIELD ON GAME FARM ROAD, AND SOUTH OF INTERNATIONAL WAY; PART OF TAX LOT 600, T17S R03W S15 MAP 30; HERETOFORE ANNEXED TO THE CITY OF SPRINGFIELD FROM THE RAINBOW WATER DISTRICT. WHEREAS, certain real property described below was annexed to the City of Springfield by order of Lane County Local Government Boundary Commission under Boundary Commission File Number EC SP 00 - 44 (Expedited Procedure) and further described in Exhibit A & B, and WHEREAS, the property to be withdrawn IS located within the boundaries of the Rainbow Water District, and WHEREAS, the City of Springfield Common Council held a public hearing and first reading in the Springfield City Council Chambers on February 20, 2001, and a second reading and adoption on March 5, 2001, in accordance with ORS 222.524, for the purpose of hearing any objections to the withdrawal of the property mentioned from the public service district mentioned and there having been no objections raised. NOW THEREFORE THE CITY OF SPRINGFIELD DOES ORDAIN AS FOLLOWS: Section 1: The Common Council of the City of Springfield does hereby determine that the real property described should be in the best interest of the City of Springfield withdrawn from the Rainbow Water District in Lane County, Oregon, insofar as the property is located therein. Section 2: The Common Council of the City of Springfield does hereby determine that the following described real property within the boundaries of the Rainbow Water District is and shall be upon the effective date of this ordinance withdrawn from the Rainbow Water District in Lane County, Oregon, said property being described as follows: Township 17South, Range 03West, Section 15, Map 30, part of Tax Lot 600; as more particularly described in Exhibit A of this ordinance and known as Boundary Commission File Number EC SP 00 - 44. ADOPTED by the Common Council of the City of Springfield this 5th day of March, 2001, by a vote of ~ for and -L against. Beginning at the Southwest comer of Parcel 2 of Land Partition Plat 94-P0498 as filed and recorded in County Survey File Number 31942, said point being on the nort4erly right of way of Game Farm Road East, said point being 40.00 feet from, when measured at right angles to, the centerline of said Game Farm Road East, said point also being North 0000'39" West, 60.00 feet and South 89056'00" West, 787.19 feet from the northwest comer of the W.M. Stevens DLC No. 46, Township 17 South, Range 3 West of the Willamette Meridian; thence following along the westerly margin of said Parcel 2, North 00000'39" West, 144.00 feet; thence leaving said westerly margin and running North 89059'21" East, 226.38 feet to a point on the easterly margin of Parcel 2; thence following along the easterly margin of said Parcel 2, South 00000'39" East, 136.37 feet to a point on the northerly right of way of said Game Fann Road East, said point being 47.45 feet from, when measured at right angles to, the centerline of said Game Farm Road East; thence following along said northerly right of way South 88003'33" West, 226.51 feet to the Point of Beginning, containing 31,735 square feet, more or less, all within Parcel 2 of said Land Partition Plat, in Section 15 of Township 17 South, Range 3 West of the Willamette Meridian, Lane County, Oregon. .
