HomeMy WebLinkAboutResolution 11-28 09/19/2011RESOLUTION 11 - 28 AUTHORIZING AND APPROVING A MEMORANDUM OF UNDERSTANDING AND WORK PLAN CONCERNING THE LANE LIVABILITY CONSORTIUM WHEREAS, the United States Department of Housing and Urban Development has award a Sustainable Cities Regional Grant to the Lane Council of Governments; and WHEREAS, one of the conditions of the Grant is that the entities constituting the Lane Livability Consortium enter into a Memorandum of Understanding describing how they will carry out the requirements of the Grant; and WHEREAS, a draft of such Memorandum of Understanding, dated September xx, 2011, (the Draft Agreement) is attached hereto as Exhibit 1 and by this reference incorporated herein; and WHEREAS, the City of Springfield is a proposed signatory of the Draft Agreement; and WHEREAS, the City Manager has submitted a report reviewing the terms of the Draft Agreement and recommending that the Draft Agreement be approved; and WHEREAS, the Draft Agreement is accompanied by a proposed Work Plan for carrying out the terms of the Draft Agreement a true copy whereof, marked Exhibit 2, is attached hereto and by this reference incorporated herein; and WHEREAS, the City Manager has reviewed the proposed Work Plan and recommended that it be approved; -and WHEREAS, the Council has reviewed the terms of the Draft Agreement and the Work Plan and is fully informed as to the contents thereof, and has determined that it is in the public interest to enter into the Draft Agreement And approve the Work Plan; NOW THEREFORE, BE IT RESOLVED, that the common Council of the City of Springfield finds and determines that it is in the public interest to enter into the Draft Agreement and to approve the Work Plan; and BE IT FURTHER RESOLVED, that the City Manager is hereby authorized and directed to execute the Memorandum of Understanding, substantially in the form of the Draft Agreement, with such changes or amendments thereto as he shall determine to be necessary to effectuate the direction of the Council and give effect to the terms of the Agreement, such determination to be evidenced by his execution of the Memorandum of Understanding; and BE IT FURTHER RESOLVED, that the Work Plan is hereby approved; and BE IT FURTHER RESOLVED, that this Resolution shall take effect upon adoption by the Council and approval by the Mayor.
