As we understand it, your proposal is to increase your wholesale inventory and add retail sales to your property on Anderson Lane (17- 03-28-04 2807 & 2809), within existing structures, and without having semitrailer trucks coming to the property for deliveries. The existing use of the property (greehhouses -- for the commercial growing of plants) is a non-conforming use under the existing Low Density Residential zoning. The wholesaling of plants, flowers and closely related products on this property is closely linked with the existing use, and can be permitted (with condit ions) . Reta i 1 sales of fl ori st and nursery products woul d not be permitted, as significant neighborhood impacts (traffic, dust, lighting, noise) could result. An application for adding retail sales (as a modification of a non-conforming use) could be accepted, but we would strongly advise against it. We feel it could not meet the criteria in the zoning code (compliance with the Metro Plan diagram -- the diagram calls for Low Density Residential uses).~ The conditions for approval of adding wholesaling to your Anderson Street operation are as follows: 1. No retail sales will be conducted on the property. 2. Deliveries or pick-ups by semitrailer trucks will not be permitted on the property (meeting them at another commercial location, as per your suggestion, is acceptable). 3. Wholesaling will be limited to items directly related to your florist/nursery business. When we receive a confirmation of these conditions from you in writing, you will be able to proceed with wholesaling. We cannot permit that activity to occur until we receive your letter.
