Ober~t. I'm not quite clear on the provisions for extensions in 35.090 (l)(a)(b) Subdivision Plat Submittal Requirements. While (b) appears to apply to subdivisions subject to Master Plan approval, I gather the time line extension as specified in (a) is required. And while I am sensitive to tbe time frame in (1 )(a), I presume we can use the appeal deadline date of March 12, 2004 as the date of approval of the Tentative Subdivision for Pbase 4. Sinee (I )(a) requires the applicant to demonstrate how the Subdivision Plat application will be submitted within the requested extension time line, perhaps it would be best for me to delay writing the letter until we meet and I <:an eonfirm speci'fic application requirements and projected dates for submittal with staff assistance. I would also like to bring along Mark Vukanovieh - he is generally in town Wednesday through Friday - and if you could set up II meeting that would be great. Oberst Jim Donovan FROM: Mike Evans RE: Extension of Approval Period, MountainGate Phase IV/SUB 2003-00062 Extension of Approval Period MountainGate Quarry ReclarnationlZON2004-0006 As you aware Springfield Development Code Article 35.090 has been revised to allow new phasing timeframes and extensions for subdivision approvals. When I asked at our meeting prior to the new code adoption. Me! and Gary Karp indicated that I might be able to take advantage of the new provisions for Phase IV of MountainGate. My interpretation oftbe new code provisions is that a two-year extension ma the Phase 4 approval but t~at a . cation u division a ro would be required to take advantage ofthe phasing timeframe aUowed under subsection (b). If you concur I will plan to submit. an applicatiori to the director. for a two-year extension of the Phase 4 approval. , W1 ,,~if;'ca. {>{'. 1.J,),v; tt.r(W"tJ.L The Discretionary Use Permit granted by the Hearings Official for quarry reclamation was approved for two years, until June 2006. Reclamarion activity was conducted in 2004 to the extent possible until prepared material~ can be removed 'and placed through the construction of Phase IV. Permits for construction of Phase IV have. not yet been issued and reclamation can therefore not be completed within the 2 year permitted timeframe. I spoke with the Heilrings Oilicial about the procedure for extension of the permit. He suggested making a request for extension which would be acted upon by him without reopening the hearing. Notice and an opportunity to comment however, would be provided to neighboring property owner~. 1 would like to follow this procedure if acceptable to the City. Almost certainly a processing fee for each request would be required but I couldn'tlocilte them in the elirrent fee schedule. Thank you for your consideration and I'll look forward to YOllr response.
