Mark,
A signed maintenance agreement with Public Works is the last outstanding condition of approval
(#9). The agreement must be signed by both parties (ie an agreement is not an agreement
without the signature of both parties) before I can advise my Director to sign the plat in
accordance with SDC 35.100(5). Eric is managing that process for you and can fill you in on the
progress.
If the agreement is signed, I will advise my Director to sign the plat when he gets back to the
office on Friday. I will place the mylars and this email on his desk in anticipation of our success.
Then we celebrate, for an hour, then we get on to the next step.

Jim: I again want to thank you for all of your attention on helping to get our.plat recorded. After 4
months or so of having the survey department review and comment on the plat, they finally
signed off last Friday.
I am unclear on what the holdup is at this time, but I suspect that it is with Public Works and may
have to do with the Storm Management Agreement. Just to remind everyone that this is the
agreement that the City supplied us and I have signed your agreement without any changes. If
the City needs to make any changes, I'm sure that I'll be okay with it, especially given the fact that
your agreement has a clause allowing the City to stop maintaining the facility at any time if they
see fit.
Jim, as you know, I have been through quite a bit on this process and together we have done a
ton of work to get us to this point. I have complied with all of the conditions, have paid the verY
hefty final plat review fees and am kindly requesting that the Planning Director sign our plat forr
recording. Please let me know if there is some other Issue at hand and what I can do to help ~
