September 27, 2006 SunTrust Land Development c/o Mark Vukanovich 780 NW York Drive, Suite 204 Bend, OR 97701 RE: MountainGate Reclamation Plan Dear Mark: The Willamalane Park and Recreation District is very supportive of the proposed park acquisition and development projects within the MountainGate housing development. The new parks have great potential of serving the needs of neighboring residents for many years to come. A condition of the Springfield Hearings Official's approval of the MountainGate Master Plan requires the applicant to submit to Willamalane a Reclamation Plan for the quarry 'that demonstrates that the proposed rehabilitation of the quarry will result in a site suitable for a neighborhood park. Sun Trust and Willamalane have jointly developed a conceptual post- reclamation grading plan for the quarry site (Exhibit A). Willamalane hereby accepts and approves Exhibit A, along with the following conditions, as the required Reclamation Plan: 1. Sun Trust will guaranty to complete the following: a. Grade and fill the site substantially as identified in Exhibit A; b. Work with Willamalane staff to create a soil base within Quarry Park that will provide sufficient soil depth, minimum of three feet, and quality to accommodate underground irrigation systems and other utilities and to ensure that grass turf, shrubs, trees and other. plants can grow well on the site; c. Install a 4'-high, black, vinyl-coated, chain link fence, or equivalent as approved by Willamalane, along the top of the vertical rock face at the northwest edge of the quarry site, provided that the cost of the fence shall count toward the $200,000 that Sun Trust is obligated, per the Agreement of Purchase and Sale of MountainGate Properly, to spend on neighborhood park improvements; d. Provide space within the parcel for at least one-acre of irrigated turf, children's playground, half-court basketball court, and landscaping; e. Install utility connections (sewer, electrical, water, stormwater) at the site in a location approved by Willamalane; f. All of the above requirements are at the sole expense of SunTrust with no financial obligation from Willamalane to support the reclamation plan. q~Ll-oCa - Date Reeelvecl: . .'. . Substantial changes to the grading plan as shown in Exhibit A shall be subject to approval by Willamalane. 3. SunTrust agrees to make every reasonable effort, including financial, to further enhance the site as a future neighborhood park by grading and filling the site to meet the grades identified in Exhibit B, the preferred conceptual site/grading plan for Quarry Park provided that Sun Trust shall not be required to make grading changes that would result in the detention basin having inadequate capacity. Willamalane agrees to assist SunTrust in locating and providing additional fill material and donated equipment to bring the site to the desired grades. . 4. Sun Trust will consult with Willamalane in developing a reclamation planting plan for the quarry site. If SunTrust approves of the conditions listed above, please sign and date below. Upon SunTrust's acceptance of the conditions, Wi llama lane will issue a letter to the City of Springfield that the District has approved the reclamation plan and provide them a copy of this letter and the corresponding exhibits, if requested. A copy of the letters will also be sent to you. Acceptance of Reclamation Plan Conditions I, Mark Vukanovich an official representative of SunTrust Land Development, LLC, hereby accepts and will adhere to' the conditions of approval for the reclamation plan required for Quarry Park as described in this letter.
