NOTICE OF PUBLIC HEARING 7 DAY RECORD EXTENSION
DISCRETIONARY USE/PARK SITE RECLAMATION

WHY YOU ARE RECEIVING THIS NOTICE:
As previously noticed, the Springfield Hearing Official did open and conduct a public hearing on
April 28, 2004 to consider all testimony for and against the following proposal:
MountainGate Park Site Reclamation (Planning File ZON2004-00006)- The applicant requests
Hearing Official approval to reclaim a 7 acre former quarry site for future park use by blasting
and crushing rock in accordance with Discretionary Use criteria of Springfield Development
Code Article 10. (Please refer to the attached previous notice for additional information.)
At the close of the aforementioned hearing, a request was granted to hold open the written
record portion of the public hearing for an additional 7 days. You are being notified of your right
to submit additional written comments in accordance with the approval criteria listed below and
the procedures listed in paragraph a., because you previously participated by submittal of
written testimony and were not in attendance when the record was held open.
YOUR RIGHT TO PROVIDE WRITTEN COMMENT:
a.. Prior to the Hearing. Official making any decision on the Application, you are
hereby.provided a seven (7) day period for the submission of written comments.
That seven (7) day period ends at 5:00 p.m. on May 5, 2004. Should you
wish to provide written comment, please direct those comments to Jim Donovan,
at the address listed below.

CRITERIA OF APPROVAL:
Reference Springfield development" code, section 10.030, Discretionary Use may be granted
only if the proposal is determined by the approval authority to meet all of the following criteria:
(1)
A DISCRETIONARY USE MAY ONLY BE ALLOWED IF THE PLANNING
COMMISSION OR HEARINGS OFFICIAL FINDS THAT THE PROPOSAL CONFORMS
TO THE FOLLOWING CRITERIA:
(a) THE PROPOSED USE SHALL CONFORM TO OTHER PERMITTED USES IN
TERMS OF SCALE, LOT COVERAGE, DESIGN, INTENSITY OF USE AND
OPERATING CHARACTERISTICS.
(b) THE PROPOSED USE SHALL NOT GENERATE MORE TRAFFIC ON LOCAL
STREETS OR MORE DEMAND FOR PUBLIC FACILITIES THAN WOULD PERMITTED
USES IN THE SAME ZONING DISTRICT.
(c) THE PROPOSED USE CONFORMS TO APPLICABLE DESCRIPTIONS OF LAND
USE DESIGNATIONS SHOWN ON THE METRO PLAN DIAGRAM. EXPANSION OF
AN EXITING DISCRETIONARY USE SHALL BE EXEMPT FROM CONFORMANCE
WITH METRO PLAN LAND USE DESIGNATIONS AND DESCRIPTIONS.
BACKGROUND INFORMATION AND STAFF REPORT:
The application, staff recommendation, all other documents, testimony and evidence relied
upon by the Hearing Official are available for a free inspection at the Development Services
Department, 225 Fifth Street, Springfield, Oregon 97477. Copies will be available at a cost of
$0.75 for the first page and $0.50 for each additional page.
APPEALS J ADDITIONAL INFORMATION:
All decisions of the Hearing Official are final unless appealed by a party to the Oregon Land
Use Board of Appeals within 21 days of the Hearings Official's decision.

NATURE OF THE APPLICATION:
The Springfield Hearing Official intends to consider the following Discretionary Use request:
. MountainGate Park Site Reclamation - The'a~Plicant requests Hearing Official approval to
reclaim a 7 acre former quarry site for future park use by blasting and crushing rock. In
accordance with Discretionary Use criteria .of Springfield Development Code Article 10 and the
. standards of Springfield Development Code Article 16, construction practices not normally
associated with residential development requite a public hearing and discretionary approval.
Park planning and design is not in question, o'nly the method of site preparation. This site was
not a permitted commercial quarry and is not subject to Oregon Department of Geology and
Mining Industry regulations. .
SUBJECT PROPERTY LOCATION:
The 7 acre project site is located along the so~th westerly border of the 330 acre site, east of S.
57'h Place, north of Weyerhaeuser Road and the Golden Terrace Subdivision at 58'h and 59'h
Streets, within Springfield's Urban Transition Zone. The site is otherwise identified as a portion
of Tax Lot 300 on LC Assessor's Map 18-02-04-11.
