Hello Jim:
Thanks for your request for the correspondence regarding extensions for MountainGate
and your offer to arrange a meeting with staff.
I'm sending the 8-17 -05 letter from Mike Evans requesting extensions for approval
periods of the MountainGate Phase 4 and the Quarry Reclamation project, as well as the
email response from Mel Oberst.
I'm not quite clear on the provisions for extensions in 35.090 (l)(a)(b) Subdivision Plat
Submittal Requirements. While (b) appears to apply to subdivisions subject to Master
Plan approval, I gather the time line extension as specified in (a) is required. And while I
am sensitive to the time frame in (I)(a), I presume we can use the appeal deadline date of
March 12,2004 as the date of approval of the Tentative Subdivision for Phase 4.
Since (I)(a) requires the applicant to demonstrate how the Subdivision Plat application
will be submitted within the requested extension time line, perhaps it would be best for
me to delay writing the letter until we meet and I can confirm specific application
requirements and projected dates for submittal with staff assistance. I would also like to
bring along Mark Vukanovich - he is generally in town Wednesday through Friday - and
if you could set up a meeting that would be great.

Phase 4 approval.
The Discretionary Use Permit granted by the Hearings Official for quarry reclamation
was approved for two years, until June 2006. Reclamation activity was conducted in
2004 to the extent possible until prepared materials can be removed and placed through
the construction of Phase IV. Permits for construction of Phase IV have not yet been
issued and reclamation can therefore not be completed within the 2 year permitted
timeframe. I spoke with the Hearings Official about the procedure for extension of the

acceptable to the City. Almost certainly a processing fee for each request would be
required but I couldn't locate them in the current fee schedule.

Mike,
The processes you propose in your letter are acceptable to the City. The fee for the subdivision extension is $228. The
fee for extension of the quarry DU is $604 plus $150 postage. The fees are found at the end of the schedule under "Point
of Sale". Thanks. Mel
