Civil Engineer Transportation: Dean Bishop, Traffic Technician IV RESPONSE TO DEVELOPERS LETTER PROJ #: ZON2004-0006 The following listed condition and items below are Public Works response to the developers letter dated May 26, 2004 as addressed to Gary Darnielle. Note that only the issues that Public Works found exceptions or further conditions are listed: Condition 4: Pursuant to SDC Articles 27, 32 and the City's intent to track fill on public and private properties to provide safe public improvements and private buildi~g sites, a Land and Drainage Alteration Permit (LDAP) may be required at the discretion of the City Engineer to track public and private fills in coordination with public improvement projects. The permit must include mateNa/specifications and final locations of processed materials, truck routes on site and offsite, electrical and water spurce locations, dewatering and temporary drainage locations and erosion control measures for operations and stockpile sites. The applicant must also submit required DEQ, DSL and USACOE permits for City review with the PIP pians and/or the required LDAP permit. 4 - page 9 Developers Response: We don't believe an LDAP is necessary for the quarry reclamation. Rock placement for streets is regulated under the Public Improvement Perl11it (PIP) required for construction of public improvements. Fill for lot development (grading outside public right of ways) is regulated by an independent LDAP permit. These permits regulate material specifications, locations of processed materials etc. If there are additional issues that need to be addressed we prefer that they be made conditions of this Discretionary Use Permit. Public Works Response: The purpose for requiring the LDAP is to establish clearly which control measures shall be used to prevent erosion and off-site sediment transport, to prevei;1t pOllution during the operation of the quarry reclamation processes. The City determined this was necessary due to the proximity to adjacent existing subdivision. The LDAP is a permit application process that City has in place that addresses these issues. If other permits by the State for the Quarry operation and/or blasting does clearly address these issues including inspections, and if the City is able review and determine that these issues are being handled by these outside agency permits, Public Works Department may be able to waive this as a condition of approval.
