The premise is, in short, to guarantee annexation in the future and build sewer when needed or requested by one of the proposed parcels or one of the lots on either side of the subject site. It is conditional, however, on the existing pre-submittal and the following: !f the applicant can, through application materials, demonstrate that: . The parcels (1 and 2 on attached map) are buildable considering setbacks, fire service and all other issues listed on the pre-submittal, and . There is a septic layout approvable by the county sanitarian considering setbacks and soil types, and . The power line easements do not preclude building on the site, Then we will accept an annexation agreement deferring the requirement to annex. The Agreement will require that the applicant and all future owners, successors, heirs, assignees and devisees of parcels 1 and 2 (southerly parcel and first panhandle) agree to participate in a PIP mainline extension and connect the two southerly parcels on the subject site at such time as one or more of the directly abutting lots on either side of Parcels 1 or 2 requests to connect. At that time we can do an annexation, a minimum of 3 lot LID andPIP/CIP for the public part of the sewer connection. The deferral requirement shall be thru a deed restriction structured similar to an Improvement Agreement and Waiver of Right to Remonstrate which shall be prepared by City. . Parcel 3 on attached map will be subject to a no build deed restriction prepared by City and executed by Applicant which shall be perpetual and binding on the successors, heirs, assignees and designees.
