We need your opinion and some discussion about this. In advance of your meeting with Jim regarding annexation and connection to sewer, Jim requested I send the attached information regarding Richard Boyles' proposed partition. Last month, Richard proposed a 3 lot partition outside the city limits but within the UOB. Annexation was not proposed and each lot would be served by a septic system. The property is zoned LDR (Low Density Residential) with the UF-lO (Urbanizable Fringe) Overlay. The property is adjacent to the city limits and sanitary sewer is within 300 feet. The application was deemed incomplete since annexation and connection to sewer is required. He understood he could revise the application as recommended, or submit it as proposed. He disagreed with the interpretation that annexation and connection to sewer is required. The appeal 1 \ . . '\. , d' d hi- 'hi d'.' th process was lscusse as s avenue to present s argument regar mg armexatlOn to e Planning Commission, and then to the City Council. This is a summary of what we told Richard: . Due to the proximity to the city limits (adjacent) and sanitary sewer line (within 300 feet), armexation and connection to sanitary sewer is required to divide the property. . One home on the existing parcel is allowed without armexation or connection to sanitary sewer. Septic approval would be required from the County Sanitarian.
