RESOLUTION 02- ~ REAFFIRMING THE COMMITMENT OF THE CITY OF SPRINGFIELD TO THE PRIORITY ESTABLISHED FOR THE PROJECT TO IMPROVE THAT PORTION OF STATE HIGHWAY 222 WITHIN THE LIMITS OF THE CITY OF SPRINGFIELD, ALSO KNOWN AS SOUTH 42ND STREET WHEREAS, State District Highway 222 includes a portion within the city limits of the City of Springfield extending between State Route 126B (McKenzie Highway) and Springfield Creswell Highway (known as Jasper Road), which portion is commonly known as South 42nd Street; and WHEREAS, such South 42nd Street is within an urbanized area, abutted by residences, businesses and school facilities; and WHEREAS, because of the nature of development, children frequently have to cross South 42nd street both going to and going from school; and WHEREAS, South 42nd Street carries a significant volume of traffic, approximating 7,000 average daily trips, in particular a substantial volume of truck traffic; and WHEREAS, South 42nd Street is not constructed to urban standards applicable to streets in the appropriate functional class within the City of Springfield; and WHEREAS, there have been numerous accidents on South 42nd Street in the recent past, including one fatal accident involving a child riding a bicycle who collided with a vehicle; and WHEREAS, the Metropolitan Policy Committee, the designated metropolitan transportation planning authority for the Eugene Springfield Metropolitan area has proposed a project to improve South 42nd Street to urban standards (the "urban standards project"); and WHEREAS, by direction of the Springfield City Council on October 8, 2001, the urban standards project was designated the highest priority for small roadway projects within Springfield for inclusion in the 2004-2007 State Transportation Improvement Program ("STIP"); and WHEREAS, upon recommendation of the City of Springfield, the Metropolitan Policy Committee, on April 11, 2002, unanimously recommended the urban standards project as the Page 1 of 3 . . . highest priority project for small roadway projects for the 2004-2007 STIP within the Eugene Springfield Metropolitan area; and WHEREAS, upon recommendation of the Metropolitan Policy Committee, the Board of County Commissioners of Lane County, acting as an Area Commission on Transportation, unanimously recommended that the project be the highest priority project within District 5 of Region 2; and WHEREAS, Policy 2C of the 1999 Oregon Highway Plan (the "Highway Plan") provides that it is the policy of the State of Oregon to consider, in cooperation with local jurisdictions, inter jurisdictional transfers of roads and highways; and WHEREAS, Action 2C.2 of the Highway Plan provides that criteria to guide decisions in such jurisdictional transfers should include appropriate compensation for the exchange that is determined through negotiation; and WHEREAS, on March 21, 2002, the City of Springfield, acting through its Public Works Director, offered to explore how to expedite the project and offered to discuss the possibility of jurisdictional transfer; and WHEREAS, on April 23, 2002, representatives from the City and ODOT met and discussed various aspects of the urban standards project, including the possibility of jurisdictional transfer, but no agreement was reached; and WHEREAS, on May 24, 2002, the Regional Manager for the Oregon Department of Transportation ("ODOT") delivered to the City a proposed Memorandum of Understanding ("42nd Street MOU") relating to a transfer of jurisdiction of South 42nd Street; and WHEREAS, in delivering such proposed South 42nd Street MOD, ODOT asserted that if the City fails to execute the MOU on or before June 13, 2002, ODOT will advise the Oregon Transportation Commission ("OTC") that the urban standards project has been withdrawn from consideration for inclusion in the FY 2004-2007 STIP: NOW, THEREFORE, BE IT RESOLVED, that the Springfield City Council reaffirms its commitment to the improvement of South 42nd Street to urban standards as its highest priority among small roadway projects on the ODOT system for inclusion in the 2004-2007 STIP; and be it FURTHER RESOLVED, that the Springfield City Council urges the Board of Commissioners of Lane County, acting as an Area Commission on Transportation to renew and reaffirm its commitment to the improvement of South 42nd Street to urban standards as its highest priority among small roadway projects for inclusion in the 2004-2007 STIP; and be it Page 2 of 3 " . . . FURTHER RESOLVED, that the Springfield City Council authorizes and directs staff, acting through the City Manager and Public Works Director to enter into discussions with ODOT concerning a potential transfer of jurisdiction of South 42nd Street, but only under the conditions set forth in Policy 2C of the Highway Plan; and be it FURTHER RESOLVED, that the City Manager is hereby directed to report to the Council, on or before July 15, 2002, on any discussions held with ODOT in respect of the urban standards project, including any discussion relating to any potential transfer of jurisdiction.
