Mr. Baldwin,
The referenced application was submitted on July 7, 2010. On July 9, you asked the city to withhold
processing until supplemental information was submitted. On August 4, 2010, the supplemental
information was received. A completeness letter was sent on August 16. Additional material was
submitted on September 7. The intent of this decision is to document the process for verifying
compliance with the Minimum Development Standards and the requirements of the CC zone for new
businesses at the referenced location. .
Summary
. The uses listed in Table 1 comply with the Minimum Development Standards of SDC 5.15-120.
. This facility is a shopping center as defined in SDC 6.1-110. In accordance with Table 4.2 of the
SDC, no additional parking will be required, unless there is new construction.
. Tables 2 and 3 contain the Retail Sales and Professional Service uses that will not be considered
a "change of use" 'and are allowed without an MDS. Other uses may be allowed but will
require the applicable land use application. .
. Once the parking lot is improved, the shopping center will comply with SDC 5.15-120. An
MDS will not be needed for the uses listed in Tables 2 and 3, unless there is'new construction,
or a change to the location of the parking, landscaping or trash enclosure. Refer to SDC 5.15-
110(B).

Findings of Fact
Finding: A "Shopping Center" is defined in SDC 6.1-110 as "A group of commercial establishments
planned, developed and managed as a unit with off-street parking and circulation provided on the
property." The facility at 14th and Main Streets complies with this definition. Table 4.62 states the
number of parking spaces for a shopping center is: .
"1 for each 250 square feet of gross floor area, exclusive of covered pedestrian
walkways. Once a shopping center or mall has been approved, no additional
parking shall be required, unless there is new construction."
Finding: This shopping center has approximately 9800 sf of floor area, which would require 40 parking
spaces. However, the building covers most of the parcel and there is not adequate area for that many
spaces. As an alternative, the applicant will improve the existing parking lot as described in the letter
from Jim Donovan, dated August 18, 2010. No new parking will be required unless there is new
construction. The parking lot will be improved as follows:
1. Angle the front parking so the spaces are still faced onto Main Street, but angled heavily
eastward.
2. Place a protective barrier at or near the Main Street sidewalk.
3.' Close the southerly driveway onto 14th Street.
Finding: Once the parking lot is improved, the site will comply with SDC 5.15-120. Retail sales and
Professional Office uses at this site will not require an MDS, in accordance with SDC ,5-15-110(B).
Those uses are listed in Tables 2 and 3. These uses will not be considered a "change of use" and are
allowed without an MOS. These uses will not need anMDS because:
. they are not subject to the Specific Development standards in SDC 4.7-100, arid
. they are not Discretionary Uses that are subject to a hearing with the Planning Commission,
and
. The site complies with SDC 5.15-120.
Other uses in the CC zone can be allowed with the applicable land use application.

Conclusion
This decision complies with the intent of the Minimum Development Standards, which is to
support economic development by minimizing City review, ensure compliance with specific
appearance; transportation safety and efficiency; and stormwater management standards
specified in this Code, and to protect the public health, safety and welfare.
Appeals: This Type I decision is exempt from the provisions of ORS 197.195, 197.763 and
227.173 and therefore cannot be subject to the appeal provisions of SDC Section 5.3-100, Appeals.
