I was going to pen the "good news" letter to follow up my call to Gary Baldwin (14'h and Main) when Bill Kloos brought in more info and we had an interesting discussion at the counter. I would like to talk to you about the application we have in before I draft our planned response to Baldwin/Kloos. The ROW in along the southern frontage of the site is an ODOT facility and any placement of structures/bollards in that ROW may require an ODOT permit. . A barrier would need to extend from the SW property corner (projected intersection of South and West property lines) a~ least 75' east. - It would be prudent for the applicant to check with ODOT regarding required permits for placement of permanent structures in ROW. Change of Usage... Gary, I have some good news for everybody involved. After some internal discussions yesterday about the code, practical application of standards and respective responsibilities in the right of way, I think we see a path to commercial (including retail) change of use approvals. It would involve standard MD5 approval with some conditions that generally implement your offer to close a driveway, put up a barrier for the sidewalk and sharpen the angle of the parking to the east (see your letter of April 26, 2010). We should talk today when you have time and I will fill you in on the details. I think you or Dan Egan of the Chamber had a question about 5DC charges regarding the Labor Ready day labor use, let me know if that is still the case and I will get you on the path to some more info! Parking and access issued aside, day labor or employment services are definitely a needed service! Hi Gary, Just got back from a few days out of town. Hope all is well with you and yours! With regard to your question, employment agencies are permitted in the CC (Community Commercial) Zoning District subject to MD5 review and approval. The parking and other required elements of the program would be reviewed under the MD5 process. The existing shopping center parking could be used, however, employment dispatch is a very auto dependent use. My sense is that the backing of vehicles over the sidewalk and into the ODOT right of way would still have to be addressed. 2 Date Received: Planner: SH SEP 72010 W: will be glad to review the specifi!ith an application but my best advice is slto close the southwest drive way, re-stripe the southerly parking, add a small berm of asphalt near the sidewalk and market to "appointment" types of commercial uses. Howare employment services looked upon with regard to moving the space from Church to Temp Employment? IE: Is this also a change of usage? Jim: I know you find this frustrating. I hope that you understand it is just as frustrating to us to ask the City permission to rent spaces in an economy that literally is stagnant.
