Subject: Chronological Review ofMDS Activities Related to 1408 Main Street.
This timeline of events, with attached plot plan, photographs and documents have been compiled to
inform a discussion between the Director, elected officials and the applicant regarding the addition
of a commercial daycare use to the site.
o July 9, 2008- Letter from Mr. Donovan to Rev. White explaining the MDS standards and
volunteering the assistance of the DSD Department with preparing, submitting and processing
the application.
o 7/14/08- Incomplete MDS Application Accepted for relocation of a church with a
congregation of approximately 50 people from S. 42"' Street to 1408 Main Street.
o 7/14/2008- Staff begins assisting applicant to perfect the application materials at the minimum
level for an MDS review and initiates review procedures with affected staff.
o 8/29/08- MDS Approval for church issued with marginal parking numbers and design based
upon off setting hours of operation and minimal conflicts with other retail use. Decision
contains 4 conditions of approval for bicycle parking, landscaping, re-striping of minimum
parking and dumpster placement. Approval includes an advisement that building permits will
be required for internal improvements. Follow up MDS inspection approved for outdoor site
improvements.
o 1/22/1 0- Counter Visit between Rev. White and POD to discuss daycare use. POD reviews
zoning (permitted) and daycare standards for operations (consistent with state standards) and
verbally fmds that the day care is permissible as a secondary use to the churcb.
o 3/5/10- Building issues "No Permits Required" for secondary day care use based upon tbe
similar as,sembly occupancy rates.
o 3/9/10- POD issues Land Use Compatibility Letter to Rev. White for the purpose of daycare
certification with the State of Oregon. Letter states that the use is permissible as an accessory
to the church use.
o 3/23/10- Planning Supervisor learns of day care interior improvement question as a result of
firelbuilding inspection request from Rev. White. Upon discussion with PODs and MDS file
review Supervisor Donovan determines that the proposed use is a second primary use rather
than a secondary or accessory use warranting a new MDS review procedure to review viability
of the proposal based upon limited access, parking and circulation areas.
o 3/29/10- Building issues letter clarifYing occupancy issues arising from previous MDS
approval and day care proposal.
o 4/21/1 O-After staff discussions, meetings and contacts with owners and applicants, potential
MDS process and design challenge solutions discussed witb applicant. Anecdotally, the owner
is opposed to any financial burden arising from changes of use.
