Tinsley 443 Riverview Blvd. Springfield, OR 97477 Dear Tom: I am writing this letter in regards to the location of the East line of Mr. Tinsley's property line, being Lot 10, Block 24, Plat of Emerald Heights Addition to Springfield, platted in October, 1904 in Volume 4, Page 14, Lane County Oregon Plat Records and also being Tax Lot 3700, Map No. 17-03-34-1-4. My findings are based on a property survey performed by Mr. Marion Hale dated May, 1950 and recorded in the Lane County Surveyors office as File No. 7967 in May, 1950. We found four 1/2 inch iron pipes that Mr. Hale indicated that he set from which we projected the East line of Mr. Tinsley's property. From our office calculations based on our field survey, we determined that the northeast comer of the wood form for the footing ofMr Tinsley's new carport is 4.93 feet West of the property line and the south end of the form is 4.43 feet West of the property line. The copy of the Ten (10) foot dedication which you faxed to me on August 22, 1995 does not give a definite description of the location of the roadway southerly from the north ,line of the lots to the south line of the lots affected. I am taking the position that the 10.00 foot roadway lies within Lot 11 as indicated on Mr. Hales survey map because Mr. Hale performed his survey 9 years after the dedication was signed and the property owners at that time should have known what the intent as to the location was. I had a conversation with Mr. Don Rogers, City of Springfield surveyor, and we could not find an easement covering the East 5.0 feet of Mr. Tinsley's property, although up to 4.0 feet of the existing gravel driveway, which runs southerly, encroach's onto Mr. Tinsley property at one point.
