A RESOLUTION ADOPTING RIGHT OF WAY USE FEES APPLICABLE TO LOCAL
WASTEWATER COLLECTION AND STORMWATER UTILITIES OWNED AND
OPERATED BY THE CITY OF SPRINGFIELD.
WHEREAS, Springfield Municipal Code Section 4.600, as amended, includes within the
definition of utility, local wastewater collection and stormwater utilities; and
WHEREAS, the City of Springfield owns and operates local wastewater collection and storm
drainage utilities; and
WHEREAS, Springfield Municipal Code Section 4.706(1)(c), as amended, provides that "All
utilities owned and operated by the City of Springfield, except a municipal utility as defined in
ORS 757.005(1), shall pay to the City of Springfield a utility fee fixed by resolution of the
Council."; and
WHEREAS, THE City manager has presented information indicating that if the fee for such
utilities were set at three percent neither utility would be required to either increase rates beyond
the rates approved by the Council nor would it be required to seek reimbursement from
customers for the right of way use fee;
NOW, THEREFORE, BE IT RESOLVED, that pursuant to Section 4.706(1)(c) of the
Springfield Municipal Code, as amended, the rate for local wastewater collection and storm
drainages utilities owned and operated by the City of Springfield shall be fixed at three-percent;
and
BE IT FURTHER RESOLVED, that this Resolution shall take effect on July 1 next following
adoption by the Council and approval by the Mayor.
Adopted by the Common Council of the City of Springfield, Oregon; by a vote of 4 for and
0 against, this 20th day of June , 2011.
