HomeMy WebLinkAboutResolution 11-15 05/16/2011r? ?J RESOLUTION 11- 15 A RESOLUTION APPROVING AN AGREEMENT IN PRINCIPLE BETWEEN THE CITY OF SPRINGFIELD, THE SPRINGFIELD ECONOMIC DEVELOPMENT AGENCY/SPRINGFIELD URBAN RENEWAL AGENCY (SEDA) OF THE CITY OF SPRINGFIELD, OREGON, AND THE STATE BOARD OF HIGHER EDUCATION ON BEHALF OF THE UNIVERSITY OF OREGON TO DEVELOP A YEAR LONG ENGAGEMENT THROUGH THE SUSTAINABLE CITY YEAR (SCY) PROGRAM OF THE UNIVERSITY OF OREGON'S SUSTAINABLE CITIES INITIATIVE AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT WHEREAS, the City of Springfield and the Springfield Economic Development Agency/Springfield Urban Renewal Agency (SEDA) of the City of Springfield, have the opportunity to enter into an agreement with the State of Oregon acting by and through the State Board of Higher Education on behalf of the University of Oregon to implement the Sustainable City Year (SCY) program of the University of Oregon's Sustainable Cities Initiative; and WHEREAS, ORS 190.010 provides that units of local government may enter into agreements for the performance of any and all functions and activities that any party to the agreement, its officers or agents, have the authority to perform; and WHEREAS, the City of Springfield provides a variety of services, programs, and infrastructure to meet the needs of Springfield area residents, businesses, and visitors; and WHEREAS, to better serve the community, Springfield proactively pursues partnership and grant opportunities to address known redevelopment, economic development, transportation, and parks planning, and general planning needs; and WHEREAS, the University of Oregon annually selects a community in Oregon with which to develop a year-long engagement through the Sustainable City Year (SCY) Program of the University of Oregon's Sustainable Cities Initiative; and. WHEREAS, through collaboration with the selected community, the University of Oregon seeks to promote research, education, service, and public outreach related to the development of livable communities and sustainable- cities; and WHEREAS, for its 2011-2012 academic year, the University of Oregon has selected the City of Springfield for the SCY Program; and WHEREAS, Springfield will involve SEDA of the City of Springfield; and WHEREAS, the City of Springfield plans to involve its Team Springfield public partners as well as provide opportunities for profit and non-profit private entities to participate in the SCY Program subject to University of Oregon approval; and WHEREAS, the SCY Program, through collaboration, will promote research, education, service, and public outreach related to the development of livable communities and sustainable cities and continue Springfield's proactive pursuit to address known redevelopment, economic Resolution No. 11-15 Page-'2 ® development, transportation, parks planning, school and education planning, and general planning needs. NOW, THEREFORE, BASED ON THE FOREGOING RECITALS, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD, as follows: 1. That certain draft agreement between the City of Springfield, SEDA of the City of Springfield, and the State of Oregon acting by and through the State Board of Higher Education on behalf of the University of Oregon for the Sustainable City Year (SCY) Program, is hereby approved subject to further review and refinement by the City Manager and the City Attorney consistent with or necessary to give effect to the present contemplated obligations of both parties under the draft agreement. 2. The City Manager is authorized to negotiate any further changes consistent with or necessary to give effect to the present contemplated obligations of both parties- under the draft agreement. 3. The City Manager is authorized to enter into an Agreement for total reimbursement payable to the University of Oregon for the actual costs incurred in the performance of the obligations under the Sustainable Cities Initiative not to exceed $229,192.00. 4. The City Manager is authorized to execute the agreement after further review by the City Manager and the City Attorney. 5. The City Manager is authorized to involve SEDA, and Team Springfield public partners, as well as private for profit and non-profit entities in the SCY Program subject to University of Oregon approval. 6. The City Manager is'authorized to execute agreements with SEDA, Team Springfield public partners, as well as private for profit and non-profit entities in the SCY Program subject to University of Oregon approval to implement the SCY Program. BE IT FURTHER RESOLVED that this Resolution shall take effect upon adoption by the Council and approval by the Mayor. Adopted by the Common Council of the City of Springfield, Oregon, by a vote of 6 for and 0 against, this 16th day of may 2011.
