Construction has not yet commenced because Arlie & Company does not have a tenant for the property at this time. We forecast grading, construction of drives and parking lots subgrade and building pads wi thin the next couple of months. However, it is not certain this will happen prior to the expiration date of our site plan approval on October 9, 2002. Arlie & Company does look to secure a tenant by this next spring. Please review and approve the extensipn to our Development Agreement. Arlie & Company must be granted the extension by October 9, 2002; please notify us as soon as possible if further explanation is needed. I am writing in response to your concern regarding Journal Number 2000-02-0040.. .. . You raise two issues in your letter: 1) has the building permit expired at the site? and 2) will the site plan review approval expire on October 9, 2002? . . . . . . . Our response to your first question follows. Building permits issued for this address were obtained on October 22,2001. Permits rerna~n valid if work does not commence within 180 days from the issuance of the pernllt, or if the work has been approved and subsequently abandoned or suspended for 180 days. A sanitary sewer inspection was requested on April 17, 2002, just under the 180 day time limitation, which validates the building permits for another 180 day period. The answer to your first question is, no the building permit has not expireo. Our response to your second question follows. Article 2 of the Springfield Development Code defines "start of construction" [I've put pertinent information in bold): START OF CONSTRUCTION. Includes substantial improvement, and means the date the building permit was. issued, provided the actual start of construction, repair, reconstruction, placement, or other improvement was within 180 days of the permit date. The actual start means either the first placement of permanent construction of a structure on a site, such as the pouring of a slab or footings, the installation of piles, the construction of columns, or any work beyond the stage of excavation; or the placement of a manufactured h9me on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling; nor does it include the installation of streets and/or walkways; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure." (-.) ) The intent of the requirement in the Springfield Development Code is to ensure that development of the building is underway within two years, and construction of a structure . is the evidence needed to meet that test. A sewer lirre could serve any development on the site. We need to see the structure that was approved during site plan approval under construction. The answer to your second question is, yes, your site plan approval will expire on October 9, 2002 if one of the following does not occur prior to. that date: construction related specifically to the structure commences OR you have applied for a one-year extension of final site plan approval which explains your delay in commencing construction and it is approved by October 9,2002.
