City of Springfield Urban Planning Division 225 5'b Street Springfield, OR 97477 Mr. Jim Donovan, We would like to bring to your attention some issues concerning the proposed 20 lot residential subdivision known as Legacy Estates. Because the west side of this proposed subdivision property adjoins the east side of our property, and also because the property dividing line was in dispute for 3 years, we are enclosing with this letter evidence of the judgment which should show legally the established property line. Issue 1: Is there legal access off of 16tb Street? We dOi;1't believe there is with only 14 ft. from the curb to our property line. There couldn't possibly be enough footage for a two way street. Issue 2: Safety---Access off of 16tb Street would mean for us that we would .not only be meeting traffic head on as we approach our driveway, but that we would have to swing across in front of traffic to enter our property---verv danl!erous. Issue 3: We have a well within a few feet of the property line dividing our property and the proposed subdivision property where the street would access off of 16th Street. This well has been used since 1938 to irrigate gardens, orchards and yards. We eat the produce watered by this well. We are extremely concerned that building a street or any structures close to this well could cave it in as it is only 25 ft. deep and was hand dug, and would contaminate the water. We question whether anything can be legally developed within hundreds of feet of our well that would not contaminate it. Issue 4: 2 things concerning flooding: 1.) Orchards have been planted in the fields below the embankment ofthe proposed subdivisions in more recent years (Harold Rice's, Joe procJfn's, McElheny and Wortenbee---developers of Grand View Estates.) They, along with: 2.) Joe prod)in and McElheny and Wartenbee filling in the canal that once let flood water flow through their two adjoining properties both have contributed to flood water backing up and flooding subdivions and other properties for the first time in 60 years that used to never be flooded upriver a mile and further from us. .," rf) , ' ' ....... -- . . We believe someone needs to responsibly be accountable for protecting people who would have a home buiIll"talong this flood plain in this particular area. In closing we would like to comment on the shortness of time we were given to respond on this matter. We were out oftown and could not get an attorney at such short notice with only a few days to get this letter in, so we do protest that it seems very unfair to us.
