G NOTICE OF PUBLIC HEARINGS Planning Commissions and Joint Elected Officials Of Eugene, Springfield and Lane County NATURE OF THE PROPOSED ACTION: The City of Springfield, has initiated a text amendment to the Eugene-Springfield Metropolitan Area General Plan (Metro Plan) and an exception to Statewide Planning Goal 15-Willamette River Greenway. The proposed amendment would allow fill materials to be placed in the Willamette Greenway setback for the purpose of building a bicycle/pedestrian structure on the south bank of the Willamette River beneath the I-S Bridges. The viaduct will allow the future development of a riverfront path on the south bank of the Willamette River, connecting Eugene and Springfield through Glenwood. (File No. LRP2009-0000S Springfield; MA 09-4 Eugene; PA09-S472 Lane County) APPLICABLE CRITERIA: The following criteria are applied by the City Councils for Eugene and Springfield and by the Lane County Board of Commissioners in approving or denying a Metro Plan amendment applications: a) The amendment must be consistent with the relevant statewide planning goals adopted by the Land Conservation and Development Commission; and b) Adoption of the amendment must not make the Metro Plan internally inconsistent. These criteria are found in Section S.14-13S(C) ofthe Springfield Development Code, Eugene Code 9.7730(3), and Section 12.225(2)(a&b) of the Lane Code. SUBJECT PROPERTY LOCATION: If approved, the Metro Plan amendment and Goal 15 exception will impact about a 1200 ft. long strip of land on the south bank of the Willamette River beneath and adjacent to the 1-5 bridge in Eugene and Glenwood. DATE, TIME, AND LOCATION OF THE HEARINGS: The Planning Commissions for Eugene, Springfield and Lane County will conduct a joint public hearing on the proposed Metro Plan amendment and Goal 15 exception on September 1, 2009, in Harris Hall at the Lane County Court House at 12S East 8th Ave. in Eugene; at the hour of 5:30 p.m. The City Councils for Eugene and Springfield and the Lane County Board of COl1)missioners will conduct a joint public hearing on the same proposed Metro Plan amendment and Goal 15 exception on September 22, 2009 in the Library Meeting Room at the Springfield City Hall at 225 Fifth Street in Springfield at the hour of 7:00 p.m. ADDITIONAL INFORMATION: The application, all documents and evidence submitted by or on behalf of the applicant and the application criteria are available for inspection at the Springfield Development Services Department, 225 Fifth St. Springfield, the Eugene Planning Division, 99 W. 10th Ave., Eugene, and at the Lane County Land Managem'ent Division, 125 E. 8th Ave., Eugene, at no cost and will be provided at a reasonable cost. FAILURE TO RAISE ISSUE AND HEARING PROCEDURES: Failure of an issue to be raised at the hearing, in person or by letter, or failure to provide statements or evidence sufficient to afford the decision maker an opportunity to respond to the issue precludes appeal to the Land Use Board of Appeals on that' issue. Issues which may provide the basis for an appeal to the Oregon Land Use Board of Appeals must be raised in writing by the person testifying not later than the close of the record at or following the final evidentiary hearing on the proposal by the local government. The hearings will follow quasi-judicial procedure, including receiving testimony about the proposal that is in favor, neutral, opposed, staff response and applicant's final rebuttal. All decisions of the elected officials are final. A party may appeal the decision to the Oregon Land Use Board of Appeals within 21 days of the decision of the elected officials. Appeals to the Oregon Land Use Board of Appeals are governed by OR5 197.830 to 197.845.
