, Request: A Pre-Submittal application for Final Subdivision Plat approval was submitted
to the Springfield Planning Division on Dec. 12', 2006 for Legacy Estates Subdivision in
, north Springfield. The application proposes to create 20 legal lots. Tentative Approval
with Conditions was granted on April 7, 2006,
Status of the Application: The final plat application package is incomplete and
requires additional information for review and final approval. The submittal requirements
of SDC 3.050 and 35.090 shall be fully met prior to acceptance of mylar copies suitable
for signature arid filing, The following conditions must be met in accordance with
Tentative Subdivision Approval: '
Condition 1: Applicant shall install painted markings and/or signing as necessary to
implement any parking restrictions required by the Fire Marshall by this decision.

Condition 4: Prior to approval of the Final Plat, the applicant shall revise the proposed
4'0 foot Public Drainage Easement to comply with Section 1.4.3 of the signed and

drainage easement shall be modified for the section surrounding the proposed open
channel swale. .

provide a maintenance access way, located within the proposed 20 foot PUE between lots
16 & 17, to the existing stormwater manhole located on tax lot 400, sufficient to
accommodate Public Works maintenance vehicles.

Condition 6: Prior to approval of the Public Improvement Plan, the applicant shall
provide a maintenance access way, consistent with section 4.06.0 of the City's EDSPM,
located within and along the entirety of the public easement for the open .channel swale
and 48 inch storm pipe, sufficient to accommodate maintenance vehicles. The access
road shall have a turn around located at the end of the road.

Condition 7: Prior to approval of the Final Plat, the applicant shall submit documentation
verifYing the 14 foot public utility easement for the existing 24 inch stormwater pipe
located on tax lot 400 has been recorded. Ifthis easement has not been recorded, the
applicant shall prepare the easement and record it with the Final Plat.

by the City of Springfield as of this date. After PIP approval the draft easement shall be
submitted for review, approval and filing with the plat.

Condition 8: As required by the City and agreea to by the applicant in the signed
annexation agreement (recording number 2005-020292), issuance of building permits for
construction of dwellings on the property will be withheld until such time as the
downstream sewer improvements have been constructed and placed into service by the
City.

Condition 9: At the time of PIP review and prior to Final Plat, the applicant shall enter
into a maintenance agreement with the City of Springfield, whereby the City will provide
routine maintenance for functionality ofthe grassy swale/detention pond serving the
subdivision. The City will provide the template for the maintenance agreement.

Condition 10: During the PIP design process, the applicant shall install a backflow
prevention system acceptable to the City Engineer at the proposed outlet of the 48 inch
public storm piped system at Harvest Lane. Details of this system shall be shown on the
Public Improvement Plan.

Condition 11: During the PIP design process, the applicant shall berm the swale as
necessary to create adequate head to allow stormwater runoff to drain to the proposed 48
inch piped outfall. The applicant shall design the berm to an elevation above the lO-year ,
flood elevation of 445 feet as shown in the McKenzie River Floodplain Assessment.

Condition 12: Prior to approval of the Public Improvement Plan, the applicant shall submit
a proposed vegetation plan/seed mix for the proposed water. quality swale. The planting
plan/seed mix shall meet the requirements of the City's interim design standards as required
in Section 3.02 of the EDSPM. The City of Portland stormwater management manual may
be referenced for design.

Condition 13: To ensure a fully functioning water quality system and meet objectives of
Springfield's MS4 permit, the Springfield Development Code and the EDSPM, the
proposed water quality swale shall be shall be fully vegetated with all vegetation species
established prior to approval of Final Plat. Alternatively, is this condition cannot be met,
the applicant shall provide and maintain additional interim erosion control/water quality
measures acceptable to the Public Works Department that will suffice until such time as
the swale vegetation becomes fully established.

compliance with the applicable conditions of Flood Plain Development Pennit #SHR2005-
00008.

Condition 18: The applicant shall apply for and receive an approved Tree Felling Pennit
, prior to the removal of 5 or more trees of any species on the site.

Condition 19: Prior to Public Improvement Plan or Final Plat Approval, the public
improvement plans shall be revised to:
a) Show a non-permanent 50 foot diameter wellhead protection zone centered
over the adjacent well to protect the well to the maximum extent practical
during construction and provide detailed construction practices to
accomplish protection on all construction related permits,
b) Grade curb, gutter and street surfaces to drain away from the well inside
the 50 foot construction easement.
c) Relocate all storm and sanitary lines and any connections from the 50 foot
protection easement, or submit ODEQ approval to construct storm and
sanitary systems using pressure pipe materials within the 50 foot easement
pursuant to OAR 340-52 (Appendix A)(i)(E).

Staff Response: The applicant must submit the filed agreement, PLA, and other well
decommissioning documents prior to PIP or Plat approval.

review and approval by the planner and the City Engineer. .

SHR2005-00008- Flood Plain Development Overlay (approved concurrently on April 7,
2006). The following conditions of approval must be met prior to issuance of LDAP, PIP,
Plat and Building Permits (as applicable) and verified prior to occupancy certificates for
the subject site as a condition of subdivision tentative approval. Final approval of the
FPO Application occurs when the following conditions are satisfied prior to Final Plat and
Final Occupancy:
Condition 1: Prior to approval of public improvement plans, the Engineer of
Record for the subdivision shall demonstrate with equipment and material
specifications, required construction practices and inspections to the satisfaction
of the City Engineer that proposed plans for construction within the flood plain
(including grading) have been designed to minimize flood damage.
Condition 2: Prior to public improvement plan approval, the consulting
engineer shall stamp a letter of certification approved by the City Engineer
stating that any portion of the potable water and sanitary systems located within.
a flood plain has been designed and will be constructed to be resistant to flood
conditions.
Condition 3: The revised locaiion of the flood plain on the subject site shall be
submitted by the applicant for review and approval by the City Engineer during LDAP
and PIP preparation. The approved FEMA flood plain elevation shall be graphically
depicted on the Subdivision Final Pial.
Condition 4: A permanent monument shall be established and maintained on
land subdivided, showing the elevation in feet above mean sea level. The
location of the monument shall be shown on the final subdivision pial.
Condition 5: The LDAP, PIP, Final Plat and Building Permit plans shall contain
the. following note:
"New construction and substantial improvement of any residential structure
on Lots _-_ shall have the lowest floor, including basement, elevated to one
foot above the base flood elevation (449')."
Condition 6: Any portion of proposed public rights of way or emergency access ways
within the FEMA flood plain will be elevated as required to maintain an elevation no less
than one foot below the base flood elevation approved by the City Engineer.

Condition 7: Prior to LDAP issuance, PIP approval or Final Plat submittal, the Engineer
of Record shall re-calculate the fill necessary to construct proposed improvements and
building pads within the flood plain and provide an analysis which demonstrates the
cumulative effect of proposed fills, when combined with all other existing and anticipated
development, does not increase the water surface elevation of the base flood more than
one foot at any point.

Status of the Application: The final plat application package is incomplete and
requires additional information.for review and final approval. The submittal requirements

THIS IS NOT.A DECISION ON THE PLAT. The mylars and application fee shall
be submitted within 180 days of the pre-submittal meeting. If the applicant has
not submitted the Subdivision Plat within these times, the Plat Application shall
become null and void and re-submittal of the Plat Application shall be required
within the Tentative Approval timelines. (SDC 35.090 PLAT SUBMITTAL
REQUIREMENTS) .

Plat applications will be processed as.follows:
1. The applicant submits a Pre-Submittal meeting application.
2. Within five to seven working days, the applicant and the City conduct a pre-
submittal meeting.
3. Within 180 days the applicant coordinates any additional review of the plat and
other required documents with representatives from the City's Planning, Public
Works Engineering, and Surveying divisions until the approval criteria of SDC
35.100 are satisfied. .
4. The City will notify the applicant when the plat and other documents are .
sufficiently refined to allow for the submittal of the plat mylars.
5. The applicant submits the plat application with the mylars and all final
documentation and financial securities including the application fees.
6. Upon City signatures, the plat mylars may be forwarded to Lane County for
recordation by the applicant.
7. The applicant will deliver (6) six recorded paper copies to the Development
Services Department prior to the issuance of any building permits:
