I met one more time with Monique Sonnenfeld. I presented Ms. Sonnenfeld with
the following chart:

to the 9/25/97 pre-submittal meeting.

I explained to Ms. Sonnenfeld that the above chronology demonstrated that she
had already paved her driveway prior to the 9/25/07 pre-submittal meeting and
thus could not have relied upon information from Planning Staff that said go
ahead and pave your driveway and you won't need to put the power
underground until later. Ms. Sonnenfeld had been explaining to me that she
would not have paved the driveway had she known that the power had to go
underneath the driveway to Parcell to reach Parcel 2.
After we had recycled that discussion several times, she changed her tack.
Basically, she is now simply asking for help from Planning Staff and throwing
herself on the mercy and good will of the Planning Staff. She would like to know
if she can receive final approval of the partition now if she records a deed
restriction on Parcel 2 that indicates that no building permit for Parcel 2 shall be
provided by the City of Springfield until such time as the power to Parcel 2 is
placed underground as described in the tentative land division plan.
This would allow her to finalize the partition, not lose the money she has put into
the partition while at the same time observing the City's requirements for placing
the proposed power underground. Essentially, the bottom has fallen out of her
market.
