the development on the Bowrack
property will be submitted by
February 18, 2005. Russ Pierson
delivered 2 more drawings and a
request that the elevator
information be deferred until March
1, 2005. Russ Pierson em ailed a
drawing and 4 pages of calculations
for the TJI roof beam "trusses" and
footings.

Glu-Lam Beams: Inspection Certificate by an approved agency to be provided to City Building Inspector prior to
placement.
Ceiling Grid: After drywall approval but prior to cover.
Hold Downs Installed: Special Inspection performed prior to placement of concrete. Provide report to City
Building Inspector.
High Strength Bolting: To be done during construction by a State Certified Special Inspector. Provide inspection
results to City Building Inspector.
Structural Welds: To be done during construction by State Certified Special Inspector. Provide inspection test
results to City Building Inspector.
Final Fire Department. After all requirements of the Fire Department have been met.
Final Building: After all required inspections have been requested and approved and the building is complete.
Rough Grading: After gravel is in place but prior to placing concrete. .
Final Paving: After paving is complete.
Underslab Plumbing: Prior to filling the trench and including required testing.

TECHNICAL/PROFESSIONAL SERVICES AGREEMENT

This AGREEMENT is by and between Blneham Construction Inc. hereinafter referred to 8S CliENT, and
FEI Testing & Inspection. Inc., hereinafter referred to as CONSULTANT, Who agree as follows:
CLIENT desires to engage CONSULTANT to provide technical and/or professional servtces I" connection with
CLIENTS project designated as Alberts Commercial.
For the performance of Its services. CONSULTANT shall be paid by CLIENT In the manner and at the timEl.
hereinafter specified. The amount and tenns of the fee wfll remain valid through completion of the project
CONSULTANT agrees to perform for CLIENT such services In accordence with the following conditions.
SERVICES. CONSULTANT will provide construction obeervatlon. teatlng and/or Inspection services at the request
and direction of the CLIENT or the CLIENT'S repl'88entatlve. CONSULTANT WBrrants that Its lIlervlces are
p$rfonn~d with the uliual thoroughnes8 and competence of the teBtlng and Inspection profeaalon. No other WlmlInty
or representation, either expressed or Implied, Is Included or Intended In Its proposals, contracts or repor18,elther
wrttten or oral.
CLIENT recognizes that the services provided are not intended to n:lplace or represent geotechnical study or
foundation Investigation. The CONSULTANT shall net be reBponslble for the Interpretation by others of the
infennaUon developed.
CONSULTANT will consider all reports to be confidential correspondence between the CLIENT and the
CONSULTANT and dlsbibute test data or reports only to those persons, organizations or agencies specifically
designated by CLIENT or Its authorized representative. All field dillte, field note8. laboratory test data, calculations,
estimates and other document. preparecl by the CONSULTANT aslnlltruments of service shall remain the property
of the CONSULTANT.
In the prosecution of his work, the CONSULTANT Will take all reasonable preC!i'utlons to avoid damagB or Injury to .
subtarranean structures or utilities. The CLIENT agrees to hold the CONSUL T ANT t:larmle88 for any damage to
subterranean structures or utilities which are not called to CONSULTANT'S attentlon and correctly shown on the
plans fumlstled.
MANNER OF PAYMENT. Involeel! wfll belsaued at the ond'of each month and 81'8 due and payable upon receipt and
are delinquent thirty (30) days after date on Initial invoice. If Invoices are not paid In full prior to delinquency, CLIENT .
agrees to pay interest on the unpaid amount at the rate of 1.5% par month (annual percentage l8te 16%) from the
delinquency date. All payments received shall first be credited to payment of Interest, and then to the principal balance.
CONSULTANT may at Its option withhold delivery of reporta or other data pending receipt of flnel payment for all
services rendered.
Sarvlces will be billed on a t1me-and-materials basis.
GENERAL. In the event any term or provision of this Agreement 18 held to be Illegal or in conflict with iny law of the
State where made. the valldlty.of the remaIning provisions shall not be affected, and thl8 Agreement shall be con8tl\led
and enforced as If It did not contain the particular terms or provIsions. .
