Dear Ms. Bussear:
This letter is in response to your request for a determination on the staros of the second dwelling
unit on the above referenced properry. . .
The Gateway Refinement Plan designates this property for Low Density Residential uses. The
property is zoned Low Density Residential (LDR) and since the properry is located outside the
city limits it is also covered by the Urbanizable Fringe Overlay District (UF-IO). The LDR
zoning district allows single family homes on individual lots and may allow an accessory dwelling
unit if the orooem' is inside the city limits and the oroposal is aooroved under the standards for
accessorY dwellin" units in I 6. I 20 of the Sorin"field Develooment Cod,. .
The material you submirted indicates that in 1991 a building permit was issued on this property.
This permit (# 9U459) was. issued for an addition and remodel of an existing single family
residence. This permit was not for an additional residential unit. Based on my own research of
building permit files, 1 couid find no evidence that a building permit was issued for an additional
residential unit on this properry. The use of the addition as an accessoty.dwelling is not consistent
with the Springfield Development Code and is therefore an illegal use.
