SYSTEM DEVELOPMENT CHARGES FOR U.P TO TEN YEARS OF PREVIOUSLY PAID LOCAL. AND REGIONAL SEVER USER FEES WH.IC'H CREDTI' SHAD: BE IN THE FORM OF FORBEARANCE of SYSTEM DEVELOPMENT CHARGES. 'WHEREAS, on May 1.7, 2010, Council repealed SMC Section 4.218(1) which, required the financially responsible person who owns an assessed property for a local wastewater projec- ibe billed for monthly sewer user fees, regardless of;whether the :pr'operty is connected to the local sewer; a11d WHEREAS; on 'August 31; -201 .. the City Manager reviewed options regarding the. potential crediting of sewer user fees for those properties affected by the repeal of SMC SectionA.218(0) and WHEREAS- on September 20, October:14, and.October 25; 201.0; the Common Council was presented options regarding the potential crediting of sewer user fees for those properties: effected by the repeal 'o f SMC. Section 4.2.18(1); and WIIEREAS_,'the-Council having fully -connsidered the chatter and the options as set' forth. above. NOW, THEREFORE, the. Cornon..Council of the. City of. Springfield hereby resolves and declares, as follows: L Current property owners of those properties affected by the repeal of SPVIC Section 4.2,18.(1) shall receive. a. Systems. Development Charge (SDC) credit in the form of ?'forbearance for all local and regional sewer user fees charged for up to ten.. years; from May, l 7; 2000 to May 17 - .2010 or, if the property was purchased after. May 17, 2000, from the date of_purehase until May 17, 2010.;. and Current property owners of those properties affected. by the repeal of SMC Section 4218(1) must use the SDC forbearance described in :S.ection 1 hereinabove not later than January 31;. 2018; or at such time:as.:the septic system:on the.real.property.fails, whichever shall first occur; and; Currentproperty owners of those properties affected by- the repeal ofSMC ti . on.4118(1) are the orily parties- eligible for the. forbearance described in. Section 1 hereinabov 1 and. the forbearance described in Section1 hereinabove shall not be transferrable to any other another-person or property; and ATTACHMENT 1 Page 1 of 2 4, This- Resolution.shall . take effect upon adoption. by the Council and approval by the'May6, Adopted by -the Common Council of the City of :Springfield, Oregon, by a vote of 6 for and 0 against;.this 18th day of April , 20:11..
