The subject property is developed with a containerboard plant (paper mill) and ancillary facilities that derive primary access from an industrial driveway on 42" Street. The intersection ofthe primary entrance driveway and 42"d Street is signalized. . . Date Received: The development site was granted Final Site Plan Equivalent Map approval in early 2006 and a Site Plan Modification was approved on April 20, 2006 for relocation of an existing chip pile, chip stacker and conveyor, and truck maneuvering area (DRC2006:00021). This request is processed as a Type I application in accordance with SDC Section 5.] 7-145.C.I using the previously approved Final Site Plan Equivalent Map for context. PROPOSED MODIFICATIONS The proposal depicts construction of a water intake structure. with fish screen along the south bank of the McKenzie River, and installation of a 60" diameter tunnel for raw water intake. The fish screen will be installed below the nonnal high water mark, and the intake tunnel is to be directionally bored to minimize disturbance to the ground surface. The proposed above-ground improvements include a concrete pad for placement of raw water pumps and a small utility enclosure for electrical panels serving the pump controls. Because the above- ground improvements are proposed within 150 feet of a Water Quality Limited Watercourse (the Keizer. Slough); the proposal triggers Site Plan Review requirements prior to issuance of building penn its. The applicant has obtained penn its from affected State and Federal agencies for the water intake project prior to applying for the Site Plan Modification. DECISION Preliminary Site Plan Modification approval as of the date of this letter, subject to the conditions described herein. SITE INFORMATION The subject property involved in this request is located at 78542" Street, Assessor's Map #17-02~32-33, Tax Lot 2402. The property is located entirely within the city limits. The project area affects a small portion of the northern edge of the site, between the McKenzie River and the south edge of the Keizer Slough. The proposed .intake tunnel runs under Oregon Highway ]26 (1-105). CRITERIA FOR APPROVAL A. Thc zoning is consistcnt with the Metro Plan diagram, and/or the applicahle Rcfinement Plan diagram, Plan District map, and Conceptual Development Plan;' Finding I: The site is zoned and designated Heavy Industrial (HI) in the East Main Refinement Plan diagram. Finding 2: The proposed development is interpreted to be a private utility installation and accessory structure which are considered Pennitted Uses in the HI district (SDC 3.2-410). Conclusion: This proposal satisfies Criterion I. B. Capacity requirements of public and private facilities, including but not limited to, water and electricity; sanitary sewer and stormwater management facilities; and streets and traffic safety controls shall not bc exceeded and the public improvcments shall be available to serve the site at the timc of development, unless otherwise .provided for by this codc' and other applicable rcgulations. FEB - 6 2008 Finding 3: The site is served with all. municipal utilities including sanitary and6\!lRlt.lifSIJb(Wi'Mal and electnclty. The applIcant proposes to Install a new raw water Intake to serve the. pln'n! operatIOns. The water intake is intended Jor manufacturing processes and is not connected to, or used for, onsite potable water systems. Therefore, modifications to the public water system serving the site are not required. 1// Finding 4: The applicant proposes to extend electrical lines from the private on-site power grid for operating the intake pumps. Finding 5: There are no utilities proposed for extension to the site that would require provision of Public Utility Easements (PUEs). An easement or comparable agreement may be required with ODOT for the intake tunnel extension beneath Highway 126. The applicant is responsible for securing third-party agreements to install the proposed intake tunnel. Finding 6: The size of the proposed above-ground improvements do not warrant modification to the site's stormwater management facilities. Finding 7: The proposed development is a private utility installation and does not contain enclosed (occupied) space. Therefore, it is not expected there will be any additional vehicle trips generated by the proposed development. Finding 8: Emergency access is suitable for fire-fighting on the site. The applicant operates and maintains their own on-site fire suppression system. The proposed development has minimal combustible material, and therefore should not create an unusual fire hazard requiring special emergency response procedures from the City's Fire Department. Finding 9: The proposed development does not include enclosed/occupied space or parking areas, and therefore a lighting plan is not warranted. Any exterior lighting for the control/utility building shall be downcast and shielded to prevent glare from affecting vehicles on Highway 126. ConclusiOli: This proposal satisfies Criterion 2. C. The proposed development shall eomply with all applicable pnblie and private design and construction standards contained in this Code and other applicable regulations. Finding 10: The applicant proposes to construct a concrete pad to support the intake pumps and a small utility enclosure for the electrical panels operating the pump controls. A building permit will be required for the proposed installations. As stated previously, the proximity of the pumps and utility building to the Keizer Slough (within 150 feet) triggers the requirement for Site Plan Review. Finding II: The site already contains an operating containerboard mill and ancillary facilities. The proposed pumps and utility enclosure are adjacent to a perimeter access road that allows for monitoring of the controls and emergency response {if necessary). Finding 12: The applicant has obtained Federal and State permits for the project and will be obtaining City building permits for the structures. Due to the multi-jurisdictional review and permitting process, it is expected the proposed development will meet all required public and private design and construction standards. Finding 13: The proposed pumps and utility building are set back a suitable distance from nearby property lines, public streets, buildings, easements, and other features. Parking areas and ingress-egress points have been designed to: facilitate veQ:if:ilSlmt$tibmlit~de anrl' 1/ . pedestrian safety to avoid congestion; provide connectivity within the development area and to adjacent residential areas, transit stops; neighborhood activity centers, and commercial, industrial and public areas; minimize driveways on arterial and collector streets as specified in this Code Or other applicable regnlations and comply with the ODOT aCCess management standards for state highways. Finding 14: The proposed development is accessed through the on'site private road system and should not generate any additional vehicle trips on public roadways. There are no proposed driveways or access points that would require a supplementary traffic analysis. As stated previously, an agreement with ODOT may be required for the underground intake tunnel beneath Highway 126. However, there is no access proposed from an ODOT facility. . Conclusion: This proposal satisfies Criterion 4. E. Physical features, including, but not limited to: steep slopes with unstable soil'or geologic conditions; areas with snsceptibility of flooding; significant clusters of trees and shrnbs; watercourses shown On the Water Quality Limited Watercourse Map and their associated riparian areas; wetlands; rock outcrop'pings; open spaces; and areas of historic and/or archaeological significance, as may be specified in Section 3.3-900 or ORS 97.740-760, 358.905-955 and 390.235-240, shall be protected as specified in this Code or in State or Federal law. Finding 15: The project is adjacent to an identified Water Quality Limited Watercourse (Keizer Slough). The proposed intake tunnel is to be directionally bored from an excavated jacking pit south of the slough. After the intake tunnel has been installed, the jacking pit will be used for the raw water intake chamber. Provided that erosion and sediment control measures are implemented for the project, there should be no surface disturbance, that would adversely affect the Keizer Slough. Finding 16: The applicant proposes to install the intake structure and fish screen during a window of low flows on the McKenzie River (between July 1 and August 31). The Department of State Lands and Army Corps of Engineers have reviewed and commented on the proposal, and have issued permits for the required work. However, the applicant has not provided copies of the permits with the Site Plan Modification application. Finding 17: A Land Drainage Alteration Permit may be required for the excavation ofthe tunnel jacking pit and related site preparation work. Finding 18: Nearly one hundred percent of,Springfield's drinking water comes from wells.. Springfield's drinking water supply and water quality protection is a critical part of Springfield's Drinking Water Protection Plan. A Drinking Water Protection (DWP) Overlay District application is typically required in conjunction with any development application when the development will affect the storage, use and/or production of hazardous materials that pose a risk to groundwater (SDC 3.3-205.8.1-3). Finding 19: The proposed project is located within the 0-1 and 1-5 year time of travel zones (TOTZs) for the Weyerhaeuser drinking water well. The 0-1 and 1-5 year TOTZs are highly susceptible to contamination from chemicals that may be spilled Or leaked onto the ground surface. Special precautions,' including the safe handling and storage of chemicals, will be required during construction and operations to prevent groundwater contamination. Any chemical spills or leaks must be cleaned up immediately and cleanup materials disposed off-site and in accordance with Lane County and Oregon Department of Environmental Quality (DEQ) requirements. In every case, care shall be taken to prevent groundwater contamination. Finding 20: Based on the applicant's submittal information, the proposed development should not havean adverse impact on water quality. Additionally, it is not expected that construction or operation of the DRC2008-00006 Minor Site Plan Modification Page 4 of 5 , ,- FES - 6 2008 Oriainal Submittal ~ proposed facilities would involve the production, and/or use of Dense Non-AqueolIs Phase Liquids (DNAPLs), The applicant is advised that new use or production ofDNAPLs is prohibited on the site, -. . Finding 21: The applicant shall employ construction practices that protect groundwater resources. During construction .and operation of the water-intake facility, precautions must be taken to prevent any fluid- containing equipment used on the site from leaking, including but not limited to provision of a dedicated area for fueling and maintenance of equipment. This area is to be prepared and maintained such that spills or leaks are prevented from migrating into the soil or the stormwater management system. Finding 22: The proposed project is adjacent to an inactive channel of the McKenzie River (Keizer Slough) that could be subject to inundation during a flood 'event. However, the above-ground improvements appear to be elevated above the established FEMA 100 year floodplain level. Finding 23: Based on the applicant's submittal there are no other significant natural or historic features on the site that would influence the revie'w of this project. CONDITIONS OF APPROVAL: 1. Tbe applicant shall obtain a Land Drainage Alteration Permit for the work as may be required by the City's Public Works Department. In any eveut, tbe applicaut sball implement appropriate erosion and sedimeut coutrol measures to prevent material from entering the nearby watercourses. 2. Prior to initiation of coustructiou activities ou the site; tbe applicaut shall provide the City with copies of all State and Federal agency permits issued for the project, including but uot limited to Department of State Lands and' the Army Corps of Engineers. 3. New use, storage or production of Dense Non-Aqueous Phase Liquids (DNAPLs) is NOT permitted in the 0-1 and 1-5 year Time of Travel Zones. 4. The applicant shall employ construction and operation practices that protect groundwater resources including, but not limited to, preventing any fluid-containing construction equipment from leaking and providing dedicated areas for fueling and maintenance of equipment. Conclusion: As conditioned herein, this proposal satisfies Criterion 5. WHAT NEEDS TO BE DONE The applicant shall provide the required information and three (3) copies of the Final Site Plan prior to submittal for building permits. In order to complete the review process, a Development Agreement is required within 45 days from the date of this decision (ie. by March 24, 2008) to ensure the terms and conditions of this application are binding upon both the applicant and the City. This agreement will be prepared by Staff upon receiving the Final Site Plan, and must be signed by the property owner (or their authorized representative) prior to issuance of any building permits. .
