I state that I am the Building Safety Management Analyst in the Community Services Division, Development Services Department, City of Springfield, Oregon. 2. I state that in my capacity as Building Safety Management Analyst, I prepared and mailed the attached original and a copy of the Certified Letter which is addressed to and mailed to Jim Guthrie, 1475 S Brooklyn Street, Eugene, Oregon 97403 and a copy of the previously mentioned letter to both the resident at 286 N Brooklyn, Eugene, Oregon 97403, and the neighboring property owned by Mark and Lisa Artemenko, 288 N Brooklyn Street, Eugene, Oregon 97403 by delivering said letters at the U.S. . Eugene, OR 974.03 RE: Re: Notice and Order to Comply With The Springfield Building Safety Code Administrative Code Relative To The Unsafe And Substandard Building at 286 N Brooklyn Street, Eugene, Oregon' Dear Mr. Guthrie As a result of a recent inspection, the City of Springfield Community Services Division, Building Safety, has determined that the structure located at the above referenced location, also known as Lane County Assessors Map #17.033442 Tax Lot .0.03.0.0, for reasons below, substandard and unsafe buildings as described in the Springfield Building Safety Code Administrative Code. Lane County Assessment and Taxation records reveal that. you are the owners of this property. Article 7 of the Springfield Housing Code states in part "It is hereby found and declared that certain residential buildings or portions thereof, occupied or designed for human habitation together with appurtenant structures and premises, which are unfit for human habitation, substandard, deteriorating, in danger of causing or contributing to the creation of slums or otherwise blighted areas are considered to be contrary to the health, safety and welfare of the occupants thereof, and the public. It is hereby also found and declared that the following causes, among others, contribute to such conditions listed in subsection (a) of this section; Inadequate. original construction; dilapidation; failure to repair; lack of proper sanitary facilities and maintenance; structural or other defects; overcrowding; defects increasing the hazards of fire, accidents or other calamities; uncleanliness; inadequate heating, lighting and ventilation or any' combination of such circumstances." . Section 2.03 of the Springfield Building Safety Code Administrative Code classifies structures which are structurally inadequate or dangerous to human life as unsafe. Section 1.0.01 of the Springfield Housing Code specifies conditions constituting substandard buildings.. The following conditions include but are not limited to conditions existing at the structures identified . above, classifying them as substandard and unsafe buildings. , Substandard Structure 286 N Brooklyn, Eugene July 31, 2007 Page 2 .1 1. The above referenced structure is occupied and currently without permanent electrical service. The occupants are receiving electrical service from a neighboring property, and then to a recreational vehicle by use of extension cords. The Oregon Electrical Specialty Code states in Article 210.25 "Branch circuits in dwelling units shall supply only loads within that dwelling unit or loads associated only with that dwelling unit." By using electrical power from another unit, both units and the recreational vehicle .are in violation and the use of the extension cord shall cease immediately. 2. As stated above, the property is not currently served with electrical service. The Code further states that where there is electrical power available within 300 feet of the premises of the building, such building shall be connected to 'electrical power. 3. All fixtures shall be connected to an approved system ofwater supply and provided with hot and cold running water. Although these fixtures may be.installed in the dwelling, the _ lack of electrical service produces inadequate plumbing facilities due to no hot water capabilities at this time. 4. Section 401 of the Springfield Building Code Administrative Code defines any attractive nuisance which may prove detrimental to children whether in a building, on the premises of a building, or upon an unoccupied lot. This includes any abandoned wells, shafts, basements, or excavations; abandoned refrigerators and motOr vehicles; or any structurally unsound fences or structures; or any lumber, trash, fences, debris, or vegetation which may prove a hazard for inquisitive minors. Any attractive nuisance as identified above mustbe removed. Section 204 (b) of the Administrative Code provides procedures where the Building Official may require vacation of the premises when cited deficiencies represent an immediate hazard to life, limb, property or safety of the public or its occupants. Notice is hereby served that the property. and all structures on the property is being posted to be vacated by 9:00 a.m. Friday, August 3, 2007 due to the potential hazards to the occupants resulting from the above cited conditions. If you, or your tenants do not vacate the premise within the. time frame specified, the City will seek compliance with the Building Safety Codes through legal recourse, which may include Municipal Court proceedings. . Once the property has been vacated, occupancy may n'ot take place until the above mentioned unsafe and substandard conditions are corrected and approved by this office. Any person having any record, title or legal interest in the building may appeal from this Notice and Order to the Building Board of Appeals, provided that the appeal is made in writing and filed with the Buildirig Official within three (3) days from the date of service of this Notice and Order.
