The section of South 2nd Street adjacent to this property is an urban Lane County maintained road. It is functionally classified as a Major Collector road, having a minimum right-of-way width of 70 feet for development setback purposes [LC 15.070(1)(c)(i)(ee)]. There will be no direct access from South 2nd Street. South 3rd Street is a Public Road (also called Local Access Road or LAR). The County does not maintain LARs, but may regulate their use. Transportation Planning would support a proposal that annexes South 3rd Street along with the subject property. When an LAR is annexed into the city limits, jurisdiction of the road is automatically transferred to the city without the formal surrender process of ORS 373.270. The following is informational regarding LARs: Pursuant to Oregon Revised Statutes and as adopted in Lane Code (LC) 15.010, a Local Access Road (LAR) is a Public Road that is not a County road, state highway, or federal road. Pursuant to ORS 368, the County and its officers, employees and/or agents, is not liable for failure to improve Local Access Roads nor keep them in repair. ORS further provides that a County may spend moneys on such roads only if it is determined that the work is an emergency or if: (aa) the Director recommends the expenditure; and (bb) the public use of the road justifies the expenditure proposed; and (cc) the Board enacts an order or resolution authorizing the work and designating the work to be either a single project or a continuing program. ' A facility permit is not required tor work performed within the right-ot-way of LARs. It is recommended that the applicant review the attached informational document regarding LARs before commencing work in the public right-of-way. .~ LARs.doc In accordance with Lane Manual Chapter 15.515, storm water run off from private property shall not be directed to the Lane County road right-of-way, nor into any Lane County drainage facility, including roadside ditches. Ditches adjacent to County roads are designed solely to accommodate roadway storm water run off. Thank you for providing the opportunity to comment.
