Please note, the building permit for this application has not been issued. SDC's are collected at the time of issuance. A final determination for calculation ofthe SDC's has not yet determined. . 8/5/2010 - Tentative Land Use Decision issued for Jackson's Food Stores, approving construction of -3500 square foot convenience store. In applicants Traffic Impact Analysis (TIA), the Engineer of Record (EOR) shows the impact of new trips based upon 1000 square feet of floor space for the new construction. Later in the document a statement inserted under "Systems Development Charges" reads that SDC's should be based upon Vehicle Fueling Positions (VFPs) and since no new VFPs will be added with development, the Transportation SDC's should be zero. . 9/10/10 - The applicant submits the building permit to the City . 9/24/10 - PW Staff engineer prepares initial SDC Spreadsheet (referred to by Mr. Reeder as "the decision") that applicant is appealing. Charges are based on land use code 851. . 10/20/10 - EOR calls Kaye Wilson and inquires about obtaining a copy of the SDC Spreadsheet. Kaye emails EOR the spreadsheet. . 10/21/10 - EOR meets w/Matt Stouder & Michael Liebler to discuss SDC's. Staff agrees that charging SDC's based on Code 851 in the ITE Manual (stand alone conveniencestore) is not appropriate. EOR states his disagreement with Code 8S1, but says he feels some charges should apply based upon the increase in trips generated by the development. EOR agrees to submit a traffic study prepared by EOR for numerous Jackson stores around the Metro area, which contains detailed information regarding traffic counts. Staff indicates SDC Methodology allows charges to be based on more accurate information submitted by EOR. . 10/21/10 - EOR submits "Trip Generation Study for Jackson's Food Stores" dated June 28,2010. The study contains traffic count data for 5 similar stores in the Eugene/Springfield area. 1 Date Received: /1/;' //kJlb Planner: AL / I r .' . . 10/22/10 - EOR sends email to Matt Stouder stating that Jackson's owners are fired up and having'a hard time swallowing the proposed $120,000 in SDC charges (based upon land use 8S1).EOR also states Eugene didn't charge SDC's for a similar use and provides documentation within email. . 10/25/10 - City staff (including the City Engineer and City Traffic Engineer) meet to discuss the June 28, 2010 study submitted by the EOR'. Agreement is made to use the more detailed study for assessment of SDC's, This is later confirmed by the Assistant PW Director. . 10/27/10 - Matt Stouder calls the EOR and discusses determination made in 10/25/10 meeting (charging SDC's based upon the specific traffic counts provided by the June 28, 2010 study), The EOR agrees to work with Michael Liebler to prepare a correlation between PM Peak Traffic Counts and Average Daily Trips (ADT), since the June 28, 2.010 study is based on PM Peak and the City's transportation SDC charges are based on ADT. . 10/27/2010 - The EOR emails Michael Liebler and Matt Stouder, indicating he passed the information on to his client (regarding using the trip study to calculate SDC's and coordinating a factor between PM Peak and ADT). The email states the applicant does not agree with the proposed method for assessing SDCs, and feels SDCs should not be charged forthe development since the number of vehicle fueling positions has not changed. He states the applicant is considering how they want to proceed, and he will work with us once he has direction from them. . 11/1/10 - Attorney Michael Reeder sends an appeal letter to Gino based on the October 20th SDC spreadsheet. Based upon the above information, no "decision" has been made (meaning the SDC assessment has not been finalized). The current status of the building permit is on hold, pending resolution of the SDC issue, Please let me know if you need any additional information.
