Goals
1. Prevent contamination of the groundwater.
2. Assist BJ Equipment in occupying the site as soon as possible.
3. Establish a framework for minimal review of future site improvements.
Approach
Limit the review to compliance with the DWP regulations. The only required site
improvements will be associated with the DWP. Use the Final Site Plan Equivalent (FSE) to
work around the Type 2 Modification threshold and the Nonconforming Use provisions for
future site improvements.
Applications
Drinking Water Protection Overlay (DWP). This will determine what site improvements, if any,
are needed to comply with the DWP regulations. The fee is $1071.
Final Site Plan Equivalent (FSE). The fee is $3,949.05. The MDS that was submitted can be
withdrawn/ converted and the MDS fee ($762.30) can be applied to the FSE.

Next Steps
1. Submit the DWP. Amy and I will need to visit the site. The typical method of preventing a
spill from entering the groundwater is paving and directing the contaminant into a drain
that is connected to sanitary sewer or a swale. A different method may be used to
accomplish the same result.
DWP will need:
. Material Safety Data Sheet
. Hazardous Materials Management Plan
Site specific information. Topics for discussion:
. secondary containment
. spill kits
. more information on the oil separation and settling vaults.
. how a spill on the unpaved area will be addressed. How will a spill be prevented
from entering the groundwater if it occurs on an unpaved area?
o what is connected to sanitary vs. storm drains?
2. Submit the FSE. Once the specific improvements to address the DWP requirements are
identified, submit the FSE. The FSE grants site plan approval to the nonconforming use and
opens up the option for future site improvements to be approved with the lowest level of
review (Building permit, MDS or Type 1 Modification). Without the FSE, a future site
improvement will require a Type 2 or 3 site plan review. Refer to SDC 5.8-100 and SDC
5.15-110.
3. Withdraw the MDS application. The information submitted with this app will be used for
the FSE.
4. Construct the improvements. This may require a building permit.
5. After the final inspection, occupy the site.
