From: SMITH Jerry Sent: Monday, February 2S, 2008 10:03 AM To: TOWERY Jeffrey; GRILE Bill Subject: RE: Fred Simmons Re: Article in Paper Today While the problems are related to the extent that the same people are likely involved in the two issues, the Bridge issue enables the transients to flourish which leads to the presence of the transients in the area Fred is referring to in his comments. Attacking the problem in one area and ignoring the other is merely "spinning wheels." 1. The police must work with the property owners to deal with the trespass issue. The police do make "runs" through that area and remove the people camping, but the convenience of proximity to their financial resources and booze make this an attractive place to retu m. 2. Willamalane has been great with regard to trespass issues on their property. 3. Areas merely in public domain become thorny for police in that the public, whether ODOT, County, or City property are much more difficult if the governmental entities are unwilling to post for no trespassing and follow up with enforcement. 4. Annexation, as I have previously stated, will provide the ability of the police to intervene in the drinking in public, which these folks by and large live for. The drinking issue does not occur in other locations of the City where panhandling is occasionally or frequently occurring. 5. I believe that we will be advantaged if Council were to adopt an ordinance prohibiting the passing of money/property to and from vehicles that are not legally parked. This would intervene in the panhandling behavior of these people. 6. The roundabout will help immensely, but until that occurs we are confronted with the current physical layout that is problematic at best. 7. It would be helpful if ODOT would trespass the people living under the bridge and on ODOT property. It seems to me that ODOT has accepted tremendous liability by knowingly allowing these people to occupy the property as a residence. Given the alcohol and drug activity that ODOT reasonably has knowledge of and the clear potential of injury to those either residing at the site or passing by, I could envision an argument of liability based upon their failure to take action to remedy these conditions. Merely cleaning up garbage and needles every few weeks does nothing to change the conditions. 8. One of the transients was quoted in the newspaper that they will merely find another location. This is the argument for the previously mentioned ordinance. Just a few of my thoughts. Fred Simmons called and he had read the article on the front page today regarding Glenwood and the transients and he wondered who is going to be in charge of patrolling the transients if this area is annexed into Springfield when the south side of the Mill Race currently is in Springfield city limits but they are not being dealt with.
