SUB2007-00053, Syrios Partition
Condition 7 of the tentative partition approval issued November 14,2007 requires
installation of a paved driveway prior to partition plat. The applicant submitted an appeal
of this and two other conditions on November 28, 2007 (Case lON2007-00073). The
appeal was later withdrawn.
Staff agrees with the applicant's contention that the unimproved nature of the fronting
street (Union Terrace) and the uncertainty about where to terminate a paved driveway
approach (ie. where the curb cut and tie-in point would be for a future paved street) does
not warrant installation of a paved driveway at this time. Any installation of a paved
driveway serving this property would be at the discretion of the property owner;
however, it was waived as a condition of partition plat.
The partition plat was approved and recorded without the paved driveway being installed
(Case SUB2009-00001, recorded January 28, 2009 CSF 41371).
