The applicant waives the 120-day deadline. We understand from your letter that the applicant retains the right to restart the pending local appeal process with written notice to the city. I am curious how ORS 227.178(5) fits into this picture: "The 120-day period set in subsection (1) of this section may be extended for a specified period of time at the written request of the applicant. The total of all extensions may not exceed 245 days." It likely won't be an issue given that we only have one 30-day extension thus far. The applicant is proceeding with the related final approvals, consistent with the blessing in your letter. Thank you for the efforts of your office and city planning staffto get the wrinkles worked out in a way th t will help get this little project in the ground.
