I have reviewed the materials provided with the subject apPlicatibn. The recommended findings and conditions outlined below are provided for your use i~ preparing the land-use , decision. SANITARY SEWER Finding: Section 4.3-105.A ofthe SDC requires that sanitary sewers shall be installed to serve each new development and to connect developments to existirig mains. Additionally, installation of sanitary sewers shall provide sufficient access fori maintenance activities. Property currently has existing sanitary sewer service from an existing 8" waste water line located at the west end of property thus satisfYing this requirement. Fi~di.ng: The appl!cant has indicated there is an existing s~tary serer serving the existing bUlldmg. The bUlldmg lateral connects to an eXlstmg 8" Ime located at the west end of property located within an existing 14' sanitary sewer easement Finding: The applicant has indicated the existing outdoor trash dumpster will be removed and relocated to the interior of the building. Therefore, there will be no. rieed for a sanitary sewer connection to an exterior enclosed trash enclosure. I I STORMWATERMANAGEMENT' I Finding: Section 4.3-110.B of the SDC requires that the Approval Authority shall grant development approval' only where adequate public and/or private Jtormwater management systems provisions have been made as determined by the Public W&rks Director, consistent , with the Engineering Design Standards and Procedures Manual (EDSPM). . I Finding: Section 4.3-110.D of the SDC requires that run-off from la development shall be directed to an approved stormwater management system with sufficient capacity to accept the discharge. ~ Finding: To comply with Sections 4.3-11 O.D & E, stormwater runoff from the site will be directed into a water quality bio-swale prior to discharging into the public system. The bio- swale drains to a private 6" storm pipe that is connected to an existing 39th Street curb inlet. I The curb inlet discharges to a 10" pipe that drains to the main 15" public storm system in 39th , Street. Storm water pipe work in the public right-of-way will require a City encroachment . J , Finding: The applicant has proposed that existing impervious areas on site will drain to a 6" trench drain with a sump pump and discharges to the bio-swale by a 2" pressure line. Condition: Prior to commencing work in the public right-of-way or in a Public Utility Easement (PUE), including connection to the existing curb inlet, the applicant shall obtain a City encroachment permit. WATER QUALITY Finding: As required in Section 4.3-11 O.E of the SDC, "a development shall be required to employ drainage management practices approved by the Public Works Director and consistent with Metro Plan policies and the Engineering Design Standards and Procedures Manual." Finding: Section 3.02 of the City's EDSPM states the Public Works Department will accept, as interim design standards for stormwater quality, water quality facilities designed pursuant to the policies and procedures of either the City of Portland (BES), or the Clean Water Services (CWS). Finding: Section 3.03.3.B of the City's EDSPM states all public and private development and redevelopment projects shall employ a system of one or more post-developed BMPs that in combination are designed to achieve at least a 70 percent reduction in the total suspended solids in the runoff generated by that development. Section 3.03.4.E of the manual requires a minimum of 50 percent of the non-building rooftop impervious area on a site shall be treated for stormwater quality improvement using vegetative methods. The applicant has complied with this requirement for all new impervious areas proposed: Finding: To meet the requirements of the City's MS4 permit, the Springfield Development Code, and the City's EDSPM, the applicant has proposed a private vegetative water quality swale. The private vegetative swale will be located at the north end of site and complies with this requirement; however, an "erosion control" seed mix will need to be provided. Finding: The vegetation proposed for use in the swales will serve as the primary pollutant removal mechanism for the stormwater runoff, and will remove suspended solids and pollutants through the processes of sedimentation and filtration. Satisfactory pollutant removal will occur only when the vegetation has been fully established. Finding: Plans indicate there is an existing boat transfer well on site; however, detailed information was not provided showing the operation of this well and the method of treating and discharging the contaminated water. ., ". ...... . . Condition: To ensure a fully functioning water quality system ~d meet objectives of Springfield's MS4 permit, the Springfield Development Code and thp EDSPM, the proposed private vegetative water quality swale shall be fully vegetated with all vegetation species established prior to approval of Final Site Plan. Alternatively, iftbis tondition cannot be met, the applicant shall provide and maintain additional interim erosi6n controVwater quality measures acceptable to the Public Works Department that will suffide until such time as the swale vegetation becomes fully established. PUBLIC STREETS, SIDEWALKS & IMPROVEMENT AGREEMENTS Finding: The 39th Street frontage is already improved and applicant I proposes no new street improvements; therefore, an improvement agreement -will not bel necessary. There are modifications to the driveway being proposed that will need to be reviewed and permitted through a City driveway permit application: UTILITIES. EASEMENTS AND RIGHTS OF WAY Finding: The applicant has indicated on plans an existing 7 ft. Public Utility Easement adjacent to the 39th street right-of~way thus complying with SectionI4.3-140.A of the SOC. There is also an existing 14' Sanitary Sewer easement located on the West end of property. Finding: The applicant has indicated on plans that there are two shed itructures located within the 14' Public Utility Easement (PUE). The shed structure encroacmhent is in violation with Public Utility Easement requirements where no building or structurds or roof overhangs are allowed to encroach into PUE. Condition: Prior to Final Site Plan approval, the applicant shall coordinate with adjacent property owner and relocate the existing shed structures out of the PuBlic Utility Easement. I FEES AND PERMITS SYSTEMS DEVELOPMENT CHARGE: I Pay applicable Systems Development Charges when building permits are issued for developments within the City limits or within the Springfield Urban @rowth Boundary_ (The cost relates to the amount of increase in impervious surface area, trankportation trip rates, and plumbing fixture units. Some exceptions apply to Springfield IUrban Growth areas.) [Springfield Code Chapter II, Article 11] I _ - Systems Development Charges (SDC's) will apply to the construction of buildings and site improvements within the subject site. The Charges will be based upon the rates in effect at the time of permit submittal for buildings or site improvements on dach portion or phase of the development. SANITARY SEWER IN-LIEU-OF -ASSESSMENT CHARGE: Pay a Sanitary Sewer In-Lieu-of-Assessment charge in addition to the regular connection fees if the property or portions of the property being developed have not ~reviously been assessed or. qtherwise participated in the cost of a public sanitary sewer. qontact the Engineering Division to dete~i~eifIn-Lieu-of-Assessment charge is applicable. lOrd 5584] .' OTHER CITY PERMITS: Encroachment Permit or Sewer Hookup Permit (working within right-of-way or public easements) example: new tap to the public storm or sanitary sewer, or adjusting a manhole. [The current rate is $135 for processing plus applicable fees and deposits] Land & Drainage Alteration Permits (LDAP).
