RESOLUTION NO 03-48
A RESOLUTION INITIATING EXPEDITED ANNEXATION OF CERTAIN
TERRITORY TO THE CITY OF SPRINGFIELD AND REQUESTING THE LANE
COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION APPROVE THE
ANNEXATION.
WHEREAS, The City Council is authorized by ORSI99.490(2)(a)(B) to initiate
annexation upon receiving consent in writing from a majority of the electors registered in
the territory proposed to be annexed and written consent from owners of more than half
the land in the territory proposed to be annexed; and,
WHEREAS, no registered voters reside within the territory to be annexed; and,
WHEREAS, the property owners of subject territory described in Section 1 below signed
a consent to annex (Exhibit A); and,
WHEREAS, the applicant is proposing to annex said property for future residential
development; and,

WHEREAS, the territory to be annexed is within the Eugene-Springfield Urban Growth
Boundary and it has been demonstrated the property can be provided immediately with
key urban services.
NOW THEREFORE THE CITY OF SPRINGFIELD DOES RESOLVE AS FOLLOWS:
Section I: The Common Council of the City of Springfield does hereby recommend
approval of the expedited annexation of the subject territory to the City by the Lane
County Local Government Boundary Commission, Lane County, Oregon, said territory
being described as follows:
Beginning at a point in the center of the county road and in the West boundary line of
the Felix Scott, Jr. Donation Land Claim No. 51 South, Range 3 West of the
Willamette Meridian, 2756.165 feet North of the Southwest comer of said donation
land claim; thence EAST 30.00 feet to a point on the east margin ofthe county road,
30.00 feet from, when measured at right angles to, the centerlin,e of said road, said
point being the southeast corner ofthat certain tract land conveyed to Marc Grassauer
in a deed recorded June 12,2003, Reception No. 2003-053419 ofthe Lane County
Oregon Deed Records, in Lane County, Oregon, and the TRUE POINT OF
BEGINNING of the herein described tract of land; thence along said east margin of
the following two courses and distances: NORTH 87.94 feet, and North 45 degrees
. East 28.28 feet to a point on the south margin of County RoadNo. 840 (Yolanda
Street); thence along said south margin, bearing EAST 225.34 feet; th.eJ;lce leaving

said south margin, bearing SOUTH 107.94 feet; thence WEST 245.26 feet to'the .

Section 2: The Common Council further requests the Lane County Local Government
Boundary Commission approve the proposed expedited annexation in accordance with

ORS 199.466 without the study, public hearing and adoption of a Final Order required by
ORS 199.461.

This Resolution shall take effect upon Adoption by the Council and Approval by the
Mayor.
ADOPTED by the Common Council of the City of Springfield this21L-th day of October

ANNEXATION TO THE CITY OF SPRINGFIELD
TO: LANE COUNTY LOCAL GOVERNMENT BOUNDARY COMMISSION
We, the undersigned, constitute the owners of at least one-half of the land area of the property described in the
attachment marked "Exhibit A" AND
We desire to be annexed to the City of Springfield. A map is attached marked "Exhibit B," showing the
affected territory and its relationship to the present city limit boundaries.
The annexation constitutes a minor boundary change under the Boundary Commission Act and should therefore
be considered by the Boundary Commission and, after study, a Final Order should be entered by the Boundary

A parcel of land lying in the Southwest one-quarter of the Southeast one-quarter of Section 24,
Township 17 South, Range 3 West of the Willamette Meridian, being all of that tract of land
conveyed to Marc Grassauer in a deed recorded June 12,2003, Reception No. 2003-053419 of
the Lane County Oregon Deed Records, in Lane County, Oregon, said tract of land being more
particularly described as follows:
