HomeMy WebLinkAboutResolution 03-41 07/28/2003 . . . ~- ; , ~ RESOLUTION NO. 03-41 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD UPDATING THE FISCAL YEAR 2003-2004 REGIONAL WASTE WATER SYSTEM DEVELOPMENT CHARGE (SDC) FEE SCHEDULE FOR THE EXISTING ADOPTED METROPOLITAN WASTEWATER MANAGEMENT COMMISSION SYSTEM DEVELOPMENT METHODOLOGY ADOPTED BY THE METROPOLITAN WASTEWATER MANAGEMENT COMMISSION ON MAY 15, 1997 AND THE COMMON COUNCIL OF THE CITY OF SPRINGFIELD ON JUNE 16, 1997. WHEREAS, the existing adopted Metropolitan Wastewater Management Commission (MWMC) System Development Charge (SDC) Methodology (existing adopted Methodology) was approved by the MWMC on May 15, 1997 and the Common Council of the City of Springfield on June 16, 1997; and, WHEREAS, the MWMC approved an amended SDC Methodology on September 19, 2002 which has not been approved by the Common Council of the City of Springfield; and WHEREAS, the MWMC at a June 19, 2003 Public Meeting authorized the MWMC staff to undertake a comprehensive review of the existing adopted Methodology utilizing professional expertise and public involvement by consulting members of the Springfield/Eugene community who might be interested in participating in the comprehensive review of the existing adopted Methodology; and WHEREAS, review of the existing adopted Methodology will include consideration of factors relevant to the development of MWMC SDC charges based on applicable statutes and the Restated and Amended MWMC agreement between the City of Springfield, the City of Eugene and Lane County; and WHEREAS, the existing adopted Methodology continues in full force and effect and the existing adopted Methodology provides for an annual revision to the amount of the MWMC SDC rates based on periodic application of an adopted specific cost index; and, WHEREAS, the existing adopted Methodology provides for an annual revision of the MWMC 5-year CIP List; and, WHEREAS, the MWMC 5-year Capital Improvement Projects (CIP) was included in the MWMC Budget and submitted to the Common Council of the City of Springfield for approval and was reviewed and approved by the Common Council as part of the City's budget which was adopted by the Common Council on June 16, 2003; and, RESOLUTION Page -1- . . . . . "'">"., , WHEREAS, MWMC staff has recommended t.o the Common Council of the City of Springfield that based upon the existing adopted Methodology and the update of the MWMC 5-year CIP (approved on June 16, 2003) and the periodic application of an adopted specific cost index, that the MWMC SDC rates derived from application of the reference data table more particularly described and set forth in Exhibit A (reference data table), attached hereto and incorporated herein by reference are the appropriate MWMC SDC rates for fiscal year 2003-2004. NOW THEREFORE, be it resolved by the Common Council of the City of Springfield as follows: 1. For fiscal year 2003-2004 the MWMC SDC rates shall be as set forth in the reference data table attached as Exhibit A. 2. The City Manager is instructed to take appropriate action to implement these SDC rates. S~,')\f,"",,\oe" \b I 3. This Resolution shall take effect on July~O, 2003. 4. In the event that any project set forth on the MWMC 5-year CIP approved on June 16, 2003 is finally determined to be ineligible for inclusion in the MWMC SDC rates for any reason, such determination of ineligibility shall not render the MWMC SDC rates invalid but instead the MWMC SDC rates shall be derived by adjusting the unit costs set forth in the reference data table so as to reflect the impact of the deletion of the specific ineligible project or projects. This Resolution adopted by the Common Council of Springfield this 28 day of July, 2003, by a vote 3 against.
